I may be opening some flood gates, but I'm happy to answer queries you may have with regards to Incapacity Benefit. Please note though, I can't answer questions (without research) on Income Support but will do my best to be helpful and factual. You must understand that I have an obligation to be loyal and honest, and therefore will not put myself in any fraudulent situation. I will do my best to answer any IB related questions and not individual cases. Any questions I can answer to help you will not reflect my personal opinion, but those of the DWP, whilst upholding anominity.

possible situation i will get in to this week, currently on IS (IB sick) and DLA, my GP is a complete idiot, he didnt give me a sicknote despite all the medical evidence pointing to my ill health, eventually i got one from another GP at the surgery, now the primary GP has bumped him off, so now its him and a new GP, he wont give me one so im going to ask the new GP, if i fail to secure one is that the end of my benefits ? cant i request a medical or something ?0

It's somewhat unusal to request a medical from the department otherwise known as a PCA (peronal Capability Assessment) as many are found fit for work. The PCA doesn't look at what you can't do but what you can do! You can request a PCA and should you pass you will no longer be required to supply medical evidence until the DWP doctor says it's neccessary ie 1 years time etc. If you are indeed 'sick' 'ill' you shouldn't have any worries from obtaining a medical certificate from your GP. If you cannot for what ever reason, there are other places you can try, such as, a different surgery, police doctors, hospitals or another GP within your practice. Unfortunately for some, IB is dependent on what your GP does say about you.

ok thanks, my psych says he cant give me one, only the 'main' hospital can issue them, i cant move to another surgery in the same area, i cant really go out of the area either, anyway i shall find out in just days, not the most stress free time for me anyway
the reason my GP gives for saying no is that in may 2005 i failed a medical, and that the DWP doctors have disallowed him from giving me a sicknote, despite documented evidence clearly saying on the PCA letter:
(you may issue the patient with sicknotes in the future if the patients condition significantly worsens or has a new condition)
both apply to me
i have been through hell and high water but everyone is useless, ultimately the GP has the trump card, despite medical evidences i have hes still saying no, everybody cant understand him, but i know what hes getting at :mad:0 -

OK, seems like you've been here before! Right, you psych can give you a letter or opinion to support your condition, but if they are not a govening body it may be seen as supporting evidence and not necessarily a 'med cert'. Don't be dismayed, they can count, depending on the information supplied within. If this situation is indeed stressing you out, as it;s coming accross to me, then you should have no problem getting a cert from your usual GP. A lot of people tend to calm down or 'hide' their anxieties when they attend their doctors surgeries, this is human nature. You need to document all your anxieties, worries, stress etc and take this wih you to your appointment. Any doctor worth their salt cannot ignore this. Just to clarify, the DWP 'cannot' disallow any doctor from writing a med cert, no matter what you've been told, experience or otherwise. It can't happen. A doctor may say that's the reason, but it simply cannot happen! DWP has no impact on doctors whatso ever. Ask you doctor for a med 3 (usual white sick note) and a med 4 which is a bluey/green cert which gives the DWP more info on your condition.
If the doctor does refuse, then you don't have many avenues open to you. He/She has found you fit for work. Apply for JSA until such time you can get a new cert.

Hi I have been on long term IB for some time now on DLA since 2002 I think, memory problems, anyway to cut along story short, I have been asked to go for a medical, I have had 2 of these in the past I think and these were home visits, due to me being in a wheelchair, I recently, october got awarded more DLA, high rate of mobility/middle rate of care. due to having a trapped nerve in my brain which is causing memory lost, and speech problems, is this the reason why they want me to go for another medical, or some other reason, I got a IB for work form to fill in sometime before xmas, which the local disabled action group helped me fill in, I got a letter from my GP saying I needed a home visit, but this was refused, they said they'd give me a taxi fee, but my GP says no to that, as the place I have to go to is 21 miles away in another town, so I have re-arranged another appointment, so I can get the right letter from my GP and send to IB via fax, what do I need my GP to say for them to offer me a home visit. thankyou

hi frosty box, i am on long term incapacity benefit for disk problems in my back but i would like to foster a child, for a few months then when they are sent to adoptive parents or real parents foster another, would any child allowance i get from my local authority (currently £110 per week), be classsed as income and working ??
would i lose my incapacity benefit even though the allowance is for the foster child ??

I have to attend a IB review (not sure if it's a medical or what?) tomorrow. I filled out a questionaire in Dec and got a call to say it had been passed to them and I was to attend this appointment. Can you give me any information on it?

Please can you clear something up for me.
I am getting working tax credit (my hubby works part time) and Child tax credit for two children and IS as I cant work due to an illness.
I was thinking of going part time in my husbands business so that I could claim the disability ellement of WTC. If I did that, would I loose my NI credits from the income support because that could effect my housing benefit.
Another thing, sorry if I seem a bit thick but how can I really get the disability allowance for working 16 hours a week when I am on income support because I CANT work.0 -

ok thanks frostyhe says its the DWP doctors who say no more sicknotes, but even i know thats false, but im in between a rock and a hard place, doesent help when you have mood swings :rolleyes:

In short, you can have a home visit. The Medical Board look at the evidence provided by your doctor. You said you'd been refused previously based on your doctors recomendation? It all depends on what he/she says ie, if he just states "I feel a home visit would benefit this customer" end of, then thats not considered 'strong evidence' to support a home visit. However, if he/she stated "I feel a home visit would benefit this customer because leaving the house unattened is a danger to her health and could aggrevate an already serious condition............." you get my meaning? He/she needs to explain fully to the Medical Board the total effect attending a medical would have on your health.
You also said you've been awarded DLA higher rate Mob and middle rate Care? It is my understanding that people awarded DLA Higher rate do not have to attend for a PCA. I forget if this is for Higher rate mob or care, so I'd suggest you ring your local office and ask them to check a) the DWP is aware of your DLA rate and b) if you can now be excempt from the PCA due to your DLA rate.
