    Sorry to sound very stupid on the website it states you can go back 6 years which I have done, but can you go back prior to that? I received a settlement of £1080 from HSBC which I accepted but they did not send me copies of charges, is there anyway I can go back and get these?
    Also does this process work with credit card companies as think I'm owed a few thousand in charges from there!!

    Yes it works with credit card companies, or loans or store cards

    but no - you cant go back more than 6 years, sorry!

    Some people have gone back further than six years and been successful, but the process is more complicated and requires some additional knowledge and advice.

    well its more of a - The data protection act states that they (the bank) need only provide information about you for the past 6 years.

    if you dont have them, you cant claim them. - i would figure anyway!

    It's not so much anything to do with the Data Protection Act, this has more to do with the Limitations Act 1980. This is what the banks could use to refuse payments over six years.

    As nickmack has mentioned. People have claimed over this time limit, but more knowledge is needed and this can be more complicated than a normal claim.

  • 6 years relate to the statute of Limitations act. However there are cases arguing that as the charges lawfulness was concealed by the banks that the statute of limitations is invalid on simply going back 6 years.

  • I have a question, which knowing me, has already been answered. Why the six year limit? I have a bank account from 1995/96 that was closed (circa 1996) with me owing some money (I’m still paying Midland/HSBC or rather a debt collecting agent £1 per month).

    But looking at my bank statements (I never throw them away), I paid hundreds in charges for this, that and the other.

    Question: can I still claim back these charges?
  • I wrote the initial letters in the summer but due to medical treatment am only now able to complete the process. On the court papers do I have go back six years from now or can I base it on the initial schedule of charges which I sent the bank? It does make quite a difference!

  • I have got Halifax going to court with me - they have settled for the amount up to the 6 years but are defending the amount prior to the 6 year time limit.

    So, I just wondered if anyone's been successful in settling outside of court for money that goes back more than 6 years?

    I am waiting for a court date at the moment as they have my court allocation questionaire already and as the judge hasn't yet thrown it out of court despite halifax's asking him/her to - I think I might be in with a chance!
