TALK TALK Small Claims Court Settled in Full

On the 29/09/06 I issued a summons through the small claims court in Poole Dorset quoting the 1982 Supply of Goods and Services Act alleging that T/Talk had failed to provide reasonable care and skill in executing their side of the agreement.At no time did I stop paying or threaten to break the agreement I asked for £500.00 plus £50 costs. This I have been awarded plus interest. Do not have the money yet but do have the uncontested judgement. Will keep you informed.
P.S. Trading Standards Officer MOST HELPFUL. DON'T GRUMBLE ACT!

    Is it too much to hope that other people will also take the same action, hit them where it hurts when justified, don't spend fortunes ringing India and £2 connection charges, £50 outlay at the small slaims court with T/Talk suppling all the prove you need to show that they failed to provide what they said the could deliver. So do not break the contract continue to pay, TAKE THEM TO COURT and make THEM PAY. Please let me know if I am the only one, in which case I give up!

    Great work!! I am a serial complainer, if I don't like something, I don't grumble, I fight for my rights!!!! I give great customer service in my job, and I expect it from everyone else serving me!!

    Ok, I am not with Talk Talk, but the point of this post is to congratulate you on some great work!!!

    Let us know how you get on. If I am correct, cases like this usually result in the big bad company saying they never received the paperwork and thats why they didn't contest which means you have to go through it all again.....

    Still, let us know what happens and i'll keep fingers crossed for you.

    BTW, on what basis did you claims the £500, surely not plucked out of thin air so I would be interested to know.

    MORPH3US. I will indeed keep you posted. first point is that it was sent registered so we are in receipt of a signature. They now have 1 month from the 19/10/06. I will now give you the exact wording on the judgment fom.

    If you did not reply to the claim form and believe judgment has been entered wrongly in default, you may apply to the court office giving your reasons why the judgment should be set aside. An application form is available for you to use and you will need to pay a fee.A hearing may be arranged and you will be told where and when it will take place.

    We based our money claim on the considerable amount of expense involved ie bringing in an IT expert, as I was totally unaware that T/Talk would cut us of without immediatley reconnecting us. Our daughters nursing studies had to be concluded elsewhere. so on and so forth. Regards cullin

    £2 coin savings = zero (I never get any £2 coins 'cos the rest of you are hogging them in your piggy banks!) :rotfl:

    sunshinesadly, I signed up on the 27th april 2006, phone connected 17th may 2006, told broadband would follow on 7th July cut off from my previous bb provider on the 4th september with no warning. after getting no service what so ever contacted my local trading standards officer who pointed out that under the 1982 supply of goods and services act did I feel that I was misled which I did, beliving that they had not excersied reasonable care and skill in executing their side of the agreement, therefore placing themselves in breech of the above regulations which lead to me issuing the summons. regards cullin

    Thanks hurrah, most encouraging, but I would like to stress to anyone else do not break the contract in any way (thats just what they want) you are seeking redemption as they failed to provide you with what they offered,full stop.
