    HA,
They can't turn you down. You don't need to go back to them for permission to go BR. Just do it yourself.

they told me i could not do that that the judge would look through all my statements and see i had loads of money and would throw it out £534 approx is what they came up with i think the new soa i just posted shows even more than that could not face adding it up. have been through such a roller coaster of emotions. they said that inland revenue may be sympathetic now but they would demand money when they saw my budget and suggested i should give them £100 a month. i dont know whats going on my head is fuzzy and keep getting blurred vision

OK - I think some of your disability benefits are being added into your income and should be excluded. So can you list them all?

And with 16K's worth of HMRC debt, unless you have the money, you can save the BK fees and wait for the HMRC to do you the favour.

Honey, they're lying to you. The judge will see you cannot cope with your debts. And the judge doesn't look through your statements, not ever.

Please, don't go back to them, they're making it worse for you. You can do it and we'll all help you.

we were told some benefits are not to be included in the calculations!
however your earnings are probably fair game but.......
surely you have to pay for petrol in the car anything else we might have missed.

i always thought to be insolvent was to owe more than you had in assets?
in that case surely you are insolvent
then as we should agree this point we just need to work out if there would be an ipa and then as majority of you income is benefits that cant be taken from anything other than your wage can it??
so it is starting to look better again now aint it hunny

  • i can confirm that you will get the chb and child tax credit until your son finishes college. My son is 18 and will be finishing college in June, until then i get the chb and ctc for him.

    disability living allowance
    incapacity allowance
    child tax credit
    housing benefit
    child benefit

as for the income, i dont think it should be in there as some people count it and others dont. it was an insurance taken out by my company that would run on for x amount of time after statuatory sick pay ends/ i should not be still getting it but my old employers merged with another company and i fell through the net. it wont go on forever so is not an income as such and i am disabled and unable to work long term so another reason that it should not be classed as income as i am not employed. this was one of the reasons that i thought i could not have an IVA as my income is benefits and they cant be guaranteed to be paid for duration of IVA it also said you shouild have assets i dont own house and car is through motabilty scheme so cant see how the agency clear start said it was my only solution. the more i have read about it the less it seems suitable.especially when it says average cost of one throughout its term is £7,500. what you wrote about the HMRC do you mean wait for them to make mw bankrupt surely they will say same as agency that i have enough money over to give them a chunk when they want repayments to start

Ok so the CHB/Child tax credit will continue until he leaves college so that will be June/July. How much will that take off your income?

Do you pay any thing for petrol. Motability surely don't pay your petrol costs as well.

thank you, you have been there for me all day and i really appreciate it. i too thought that disability benefits were not to be classed as income as their purpose is to add that bit extra to your income to help you manage the same as someone else who is not disbaled. am not sure if that even makes sense to me. but for that reason i gave up on CCCS and went to clear start as they advertise themselves as anon profit making agency giving people with disanlities advice on debt but even they said all benefits are counted as income and would not listen when i said that was not what i was told i thought only incapacity allowance could be counted as it was a and the only taxable benfit that can be means tested. but i am doubting every word that comes out of my mouth today.

has anyone worked out from my new figures what surplus cash i have left? i get a different figure each time i add it up?
