Okay, so we've received the last 6 years bank statements, gone through them and found all the charges.
Then we wrote to HSBC using the template letter asking for the money back.

HSBC wrote back within the 14 days saying this:

"I am looking into the matters you have raised and will contact you with a full response as soon as I have completed my investigations.

In the meantime here's a leaflet blah blah blah..."

So, what should the next step be? Are they just trying to fob us off or should we wait for this 'response'?

Don't really just want to jump straight in with the second letter about taking them to court if it's not needed just yet...
  • I too recieved a reply asking for itemised details of the charges I was claiming, even though I had included a fully comprehensive list stapled firmly to my letter.

I re-sent my list of charges claimed & offered to extend the 14 day notice from that revised date as a "gesture of goodwill".

They have taken almost 5 weeks to respond (I hadn't started court proceeding due mainly to being a little strapped for cash after crimbo). I today had an offer of 85% of my claim (not including the 8% interest), which I am going to accept as it's a pretty tidy sum & is alot less hassle than pursuing it further.

They claim not to admit liability, but ae doing it for "commercial reasons" as legal costs would be lost.

So, I'd say give them a chance to sort it out before going all the way (I know others would disagree) They obviously have a bit of a backlog to go through at present!

    The situation so far!

    1) Requested summary of charges
    2) Received statements
    3) Sent off first letter claiming £658 charges + £152.68 interest
    4) Received letter saying they are 'looking into the matter'

Now the 14 days is up and I have not received an offer - point 4) does not constitue a satisfactory response! My question is, what do I put in Martins next template letter under 'name of court'? How do I find out what my local court is? Or can I use MCOL? What are the parameters that permit you to use MCOL instead of actually physically going to court?

    Many thanks

Either look in your phone book for county court or type into search engine 'county court *town u live in*'
 I'll get you debts and your little dog too!!!
And best of luck to all the other debt busters out there!!

  • Hello - just received a letter back today (20 Feb) from the Senior Service Quality Officer at HSBC in Leeds, in response to my first letter (10 Feb, sent recorded) asking for my money back. I had enclosed a full breakdown with my letter using excel - sheet number, date, amount, etc.

"In order that we can consider your request, please provide a full itemised breakdown of these charges to include date, description of the charge and the amount applied. Please also include any proposed new charges that you have received a pre-notification advice for"

I have reshuffled my schedule using the format they want:-

    Date Amount Description
    Total

but would like to know if you think I should send this back with the pre-court letter? Is this just a delay tactic?

Thanks. Nervewracking - plus I've got to search for my court now!

    Sharon

I had exactly the same reponse from them. I did what they wanted but sent the next letter back but kept the same deadline so they only had 1 week to respond rather than 2. I'm sure it is a delaying tactic but reckon if you stick with your original deadlines thats best. Having had no reponse I sent off the second letter today!! Fingers crossed xx
    So far:-

HSBC £2515 incl int claimes, settled on £1998:j

Abbey - £2995 claimed, offered £1098, accepted as part payment and proceed to next stage, response not satisfactory so currently with Ombudsman:confused:

    Cap 1 - settled on charge difference:j

Barclaycard - settled on charge difference:j

MBNA - 1 account settled in full, £993:beer:
    - 2nd account settled on difference:T

HSBC Visa - no charges amazingly!!:rotfl:

Household Bank Visa - settled on charge difference:T

ACE catalogue - settled in full after 1 letter!!!

Just a quick note to those of you out there thinking of claiming or just starting a claim.

We had our bank charges refunded by HSBC today - the process was easy.

We used online banking to find and list all of the charges, then sent a letter demanding a refund.

We got the standard reply from Colin Langdale and hit them with the LBA. Two weeks later we received an offer of the full amount.

    Good luck to everyone else.
  • Has anyone been successful with a second claim from HSBC? I had my offer of 1000 paid into my account last week but in the meantime was stung with another 100 charge!! I sent them a letter asking them to cancel the charges before they were due to be taken out and got the standard letter back but was horrified to find they had taken them out yesterday. I've sent another letter yesterday threatening court action. Do you think I'll get them back?
  • Hate to be thick!!! but we got the standard letter from Colin Langdale too but whats a LBA?? Is that the next letter?
Well done you for the refund. Hope ours is as easy!
  • Ha I'm glad you asked that question Lisa cos I thought it was just me!! Do you think it may mean letter back again? :rotfl:
  • think so but a newbie to this so wouldn't dare say!!!! Glad its not just me who's a bit dim tonight( no offence):rotfl:
  • None taken!! Good luck with your claim.:o
