  • Would being on a DMP class you as being in financial hardship?

    I'm on a DMP so can I still proceed to reclaim as a way of reducing my overall debt?

    Also can someone confirm whether it is still ok to claim charges from Credit Card companies, like Barclaycard and MBNA, or are they classed as 'banks'

    Also what about banks credit cards like I have a NatWest credit card with loads of charges to reclaim???

    credit card claims continue and arnt covered by this
    claimed/settled - Natwest £2,535/£2,535, HSBC visa £80/£80, MBNA £1,258/£1,258, capital one £282/£282, tesco visa £515/£515, HSBC visa £140/£140. HSBC £1,450 MCOL Stayed for OFT case. Chelsea Mortgage charges & cashback £5000/£672. complaints with banks pending OFT Halifax £30, A&L £35. TOTALS £11,325/£5482

    I have the date for monument credit card - 6th Sept - will this continue then or ??? but will credit cards catch up with the banks in a week or so... I can't believe they have to wait until the banks have this test case.. they will want one too I should think!

    also started mycol for Capital One ont the 13th July.. so hoping I would get a cheque around the 8th August (my birthday on the 11th! :D )

    Does this test case not affect these... can someone write me a guarantee please.. signed.. I will sue you if you are wrong :D:D:D:p

    credit cards have already been sort of dealt with by office of fair trading but not in this way. they said they would only think a charge of more than £12 is definately unfair. nothing really resolved so your still safe in the court system and wont be put on hold unless something new changes

  • I have recently got a company to persue my Alliance & Leicester fees.Is it one of the banks involved or can this case continue?I see that ther name is not on the list. I am a bit concerned now as I have been waiting almost 2 months on statements cming back from them, possibly stall tactics?:confused:

    The OH received a phone call tonight from Cap.1 saying if he didn't accept the (measley) offer made to him then he would get nothing due to this test case going ahead.
    Just aswell we know that it doesn't apply to credit cards and this was obviously just a scare tactic - we informed him to get his facts right! ;)


    I just read this in the Capitol One thread.... so it does look like it is the same for banks and credit cards!

    Re credit cards - I just hope the courts know the difference, and don't just see a banks name and suspend the court action.

    I'm in a very similar sitution basser.

    I went down the MCOL route to reclaim £1200 from Lloyds TSB. They did acknowledge my claim but didn't defend it so I asked for judgment by default. This was issued on 18/07/07. I, too, was in a position to involve baliffs but was worried that if I pushed too hard too soon then LLoyds solicitors may ask for the judgment to be "set aside". I rang MCOL last week and they said Lloyds had been sent a letter telling them to pay me within 1 month and that Lloyds would have to show very strong grounds to have the judgment set aside (they couldn't just claim they had not had enough time).

    With this info I thought I may as well just hold on for the 1 month to pass.... and then I heard the news this morning about the OFT case.

    I rang MCOL this afternoon and the lady there said that as judgment had already been made in my favour then todays news won't effect me and if I wanted I could still issue a warrant for baliffs to be involved.

    Right now I am unsure what to do. If MCOL are right and it is just a case of holding on then there seems little point in involving baliffs (and a £55 charge!). On the other hand there is so much speculation about how the OFT case is going to effect everybody I am tempted to issue the warrant and hope to get my money while there is all the confusion.

    If anybody has any advice I'd love to hear it.

    Do you think that they will re-offer the £12 difference if there is a decision made that £12 is fair. I've partial accepted any offers - cap one take their ofer back even if you goto court though... I would rather have that than nothing after all this... better than a slap 'round the chops :D
