    im very confused at the moment.........
    i have taken the alliance and leicester through the small claims procedure...
    they did not acknowledge or defend the claim....
    on the 23july 07 judgement was entered against the bank and i was able if i wanted to, to issue a summons for baliffs to collect the money on my behalf(if i paid another £55).
    Im not sure of my posistion at the moment ...i rang the mcol and the lady said to carry on with the process...will my case be one that will be frozen???

    If it's any use to anyone.. I work for Halifax (Hbos Plc) in a branch. First I heard of this was last night on BBC News, but we have had a formal internal mailing about it this morning:

    -All legal challenges for claiming back charges are frozen until the outcome of the trial
    - Any cases where an offer has been made will be honoured if you choose to accept it. If you refuse, then the claim will be frozen until the outcome of the trial, with the offer being withdrawn.
    - SARS requests will still be processed, as that's under the Data Protection Act, and not affected by the agreement with the FSA and OFT.

    Don't know anything else about it. Was quite a surprise when I heard about it to be honest. From the business side of it, I can understand why the banks want to do it, particularly en masse, so they're backing each other up. But if they lose, they stand to lose a lot in refunding charges, which might subsequently affect personal banking. So I dunno what to think of it really.

    There's one that is for people to sign for banks to pay up with out court cases :D

    I wonder if Nationwide knew something and this is why I've not heard the court date for Nationwide.. it's been two months since the mycol part ended!

    I got a date for the 6th September for Monument Credit Card - guess I can kiss that goodbye until after December? I've been fighting them for 2.5 years... they added £90 per month in charges yet I was late for two days on one payment - never sent statements either... ignored 22 letters sent to them and their customer service kept putting the phone down.. and I asked nicely.. can you send the statements please... 'No'.. Slam??? They have to keep their end of the contract and they didn't - that's why I've gone down the reclaim charges route!

    Martin - How come, if the banks are allowed (by the FSA) to suspend their complaints procedure until the outcome of the court case, which could be many many months, except in cases of financial harship, that bank charges aren't also being suspended???

    I agree, If the banks are found liable to return all bank charges after this hearing; then surely even they can see that is cheaper in the long run to suspend all charges rather add interest on at a later date...or perhaps they don't give a damn about a few noughts on the total of their bill!!!:rolleyes:

    Well, Knew it was coming but not this soon :confused:

    Does this mean the banks dont have to give u a copy of your charges from the last six years now?

    Or do they still have to provide you with the details? after all i do have the right to that information dont I ? even if i cant do anything about it for now..

    They still have to give you the info.

    I've finally got a court date for the 3rd week in September - is it possible that it won't go ahead ???

    nearly as many signatures saying us poor people brought it on ourselves so if you want a say signt the right petition :-)
    claimed/settled - Natwest £2,535/£2,535, HSBC visa £80/£80, MBNA £1,258/£1,258, capital one £282/£282, tesco visa £515/£515, HSBC visa £140/£140. HSBC £1,450 MCOL Stayed for OFT case. Chelsea Mortgage charges & cashback £5000/£672. complaints with banks pending OFT Halifax £30, A&L £35. TOTALS £11,325/£5482
