    I've sent you 2 PMs in the last 2 weeks, but, I'm yet to recieve a reply from yourself. According to royal mail you shoud have recieved my 12th bill on 30th January - 2 weeks ago.

    Could you confirm when I will be recieving my cashback?

    Think I will have to write it off as one of lifes lessons (learn to count bill numbers!).

    Hope that some of you have better luck with your claims.

    Are you on a 18 month contract (and so diffrent rules apply to you than me)? I am sure it was bills 7-12 I had to send for my 2nd cash back on my 12 month contract but TMO say it should have been 11 then 12 within 21 of each. I was following internet T&C as per their instructions but stupidly did not keep a copy of them. I am now trying to prove them wrong and get my money.

    Yes it as an 18 month contract. The T&C's do say bills 6 - 12. After thinking about it I decided to still appeal TMO's decision on the basis that two months to process my claim is unreasonable. Had they processed my claim sooner they could have queried with me why there was no bill 6 (they could after all see that I was a genuine customer and had all of the other bills). I could have still got bill 6 to them within their relevant timescale requirements.

    I have e-mailed the address on this board and they have acknowledged my message so will keep you posted.

    I'm grateful to you for posting your experience with this. If others could add their own accounts of pursuing their unpaid cashbacks from The Mobile Outlet through the court and enforcement route it would be very helpful and it would help us to establish the number of people who are in the same position.

    It seems strange that a bailiff could not obtain payment from a company whose office is open from 9 to 5 (or whatever) on weekdays.

    What I find most bizarre, though, is that they are refusing to pay bailiffs armed with court orders but at the same time (see earlier in the thread) issuing cashback cheques to other people routinely.

    Every time a bailiff visits them, that alone is going to add at least another £50 to the costs bill they are going to have to pay.

    If your basic claim is for, say, £180 (?) and that has been compounded with the original costs of £30 plus two (so far) bailiff's fees of £75 (?), the bill is already standing at another £180 in collection costs before you even start to add the interest that is accruing to you (at the usual court rate of 8% on outstanding judgements?).

    In all probability it is going to cost them well over £200 in fees for defaulting on a cashback to you of £180 which they will still have to pay you.

    What on earth sort of business plan and financial prioritisation is that?

    Once people, under The Mobile Outlet's new arrangement of paying cashback in five instalments, start doing this over sums of £72 how can the company remain in business?

    Anyway, please do let us know how your own action progresses, AFH.

    Could you also, when it is convenient to you, be so kind as to run us through the procedure (and fees) of pursuing, to ultimate collection, the sum owed to you once it has been awarded by the SCC?

  • Spoke to Customer Care last night and they asked me to fax court papers, which I did. Said a cheque would follow.

    Alec,

    Did they specify a particular fax number for you to use or was it just their quoted fax number (0870 199 1222)?

    The good thing about fax is that you have proof it was received. You can even use it to send them a Letter Before Action, for example.
