    Hello again, bumping this thread. I have just received from 1st Cretins a "final respsonse" letter containg a copy of my original application form to Morgan Stanley (later Goldfish), containing the words "Credit agreement regulated by the consumer credit act 1974". Is this what I have been waiting for? They apologise for LCS contacting me, this was a "clerical error" (yeah, right), and asking for my proposals for settling the debt. What should I do now? Do I send them a copy of the letter I sent to Goldfish way back when, detailing my financial situation and offering the amount I had agreed with Goldfish before they passed the debt on? Your always wise advice would be much appreciated.

    Hiya,

    What they have sent you is the application form from when you applied for the credit card. This is a prospective agreement and is more than likely not to conform to legislation as it will almost certainly not contain all the perscribed terms to make it enforceable.

    I too have received that same application form from them for my Morgan Stanley (Goldfish) card and it is missing vital information to make it valid.

    What you need to do is post a copy of it on here to let one of the experts have a look to see if it is an enforceable agreement before making your next move. Obviously editing out all your personnel details and hide your identity.

  • Please forgive me if this message ends up in the wrong place this is the first time i have used the discussion board.
    I have 2 debts which have been passed to 1st credit from the halifax.
    Ihavent actually sent a letter for my cca agreement ,but i did ask for one to be sent 5 weeks ago ,yesterday i recieved an edited copy of an application for credit not an actual signed credit aggreement the exact same letter i see was sent to someone who posted a reply on this site.I have noticed on the application it states the visa card number which is completly different to my visa card number,also the date which i have supposedly signed the application is november 98 whilst underneath the date signed by a halifax employee is november 08 ,any info on this would be greatly appreciated :o

    Sounds like standard practice from 1st Credit.

    I would send an official CCA request again to them and see what they come up with. Dont forget the £1 fee. This way you are doing things by the book with regards procedure. Also, its also good to keep a papertrail of events.

    Have a look at the following thread for some more good advice. Is there any chance you could post a copy of what they have sent you on there so the experts can have a look at it to see if it is enforceable? Dont forget to omit your personal details.

    Hiya,

    I've had a look at your alleged agreement. It looks like a stardard application form to me. I cant quite make out the words as they are quite small.

    Did you get any response on the CCA thread? If not, bump it up again. Sometimes some posts get missed if there are a lot of posts in quick sucession.

    latest, Citi replied to CCA request with a bunch of statments. Citi account still on credit file, now 1st Credit have added another default file!this is not right you cannot have 2 defaults on the same file, even worse considering niether should be there as no credit agreement.
