Urgent-landlady Slinging Me Out Friday!

hello, i have a problem with my landlady and need some urgent help! i was looking for a houseshare last month after moving to london from somerset and found a very nice clean place in south london. it is a big house really beautiful and all poshly furnished but there is 4 of us sharing just 1 bathroom.

when i asked the landlady if there was problems getting into the bathroom she said that as they all worked shift work there never was and it all worked out well.

i moved in on december 14 and realized that the walk from the station to the house took me a good 15 mins and was uphill too! i mentioned it to my landlady and she said to me that i had walked up there to view the house and didn't i realize that then!

in the handwritten contract she put what was included in the rent and also said there was one months notice either way when leaving. the rent is £90 a week inclusive of gas electric water council tax wireless broadband TV etc

then last friday she said to me that i need to buy dishwasher tablets as i use the dishwasher a lot and that i cook 3 times a day. that's true, i do make porridge every morning and when i am not working i like a fry up for lunch and another cooked dinner at night. when i am working i only cook breakfast and dinner when i get home.

she said to me too that i should clean up after i have cooked and complained that everywhere is greasy afterwards. she then added that i need to buy my share of loo rolls and said that since i have moved in the house is getting thru one a day when before they only used a couple a week.

she never mentioned me buying loo rolls etc when i moved in and its not written in the contract.

then on tuesday morning after i came out the bathroom she said to me that could i try and be a bit quicker in there as the australian guy had to go to work without a shower and had to brush his teeth in the kitchen cos i was in there too long. i never times it but she said i was in there for 50 minutes and always am in there that long. so i reminded her that she had told me the bathroom situation worked out well and nobody clashed over timings of use but she said that was because they used it at different times of the day but when they did occasionally clash on timings they would only - her words - HOG IT for 15 minutes, not one hour!

she also asked me when i am going to buy my own towels and sheets (i am using hers) and as she has a large set of towels in the airing cupboard i think she is being deliberately mean.

so on tuesday night i found a cheaper place closer to work and then yesterday morning i told her i wanted to speak with her. i told her i was moving out in feb and she went nuts! she said - her words - THIS IS NOT A HOTEL YOU KNOW!

she then told me i had to pay this months rent. i had started to suggest not paying it so she didn't have to give me my deposit back.

so last night when i came in from work she went into one! she told me i was the meanest person she had ever met, that i deliberately filled the kettle for just one cup and that i used tons of hot water standing under the shower just cos it was all inclusive, that i leave grease all over the kitchen and don't clean up. she said she wants me to move this Friday!!!!! She said it - her words - IT IS NOT A SHORT TERM RENT - but she never wrote that in the contract, she just put one months notice either way. she said that i was taking the &&&&&! and could clear off now - this week!

worse still she said she will not return my deposit until she has checked how much extra the electricity bill and telephone is. i used her phone over christmas when she was away and the old dragon checked redial didn't she! i did phone abroad but am happy to pay that but as the electric was included i think she is trying it on. she said her contract meant REASONABLE USE of electric and gas but it does not say that.

two things/ can she force me to leave on friday? and can she hold on to my deposit even though she's slung me out?

  • Well legally if you have a contract she can not throw you out but then its going to be an awkward situation and you would owe her a months rent a deposit isnt there to be used as your last months rent even though a lot of tenants seem to think it is, as for the deposit well probably she can keep it but you can try to legally claim it back.

    You should re-read your post and put yourself in her place because from what you have posted i would not want to share with you either if what half of what you say she has stated is true, I mean wth you do not have your own towels and you didnt notice a hill?

    Your either a troll or you need to take a long hard look at how you are living because its not like living with your parents you know!

    First of all, you're not a tenant, you're a lodger. Second - and "don't take this personally" - I don't blame her for wanting you out. You sound like the lodger from h*ll. This is not a hotel, or your mum and dad's place, it's a SHARED living situation. It sounds to me as though you have never learned the basic human skills of sharing anything. And as for thinking SHE was sneaky for checking redial, how about you asking permission before making an expensive phone call at someone else's expense? And were you cleaning up after yourself in the kitchen? If not, then she was perfectly within her rights to complain. Oh, and an uphill walk? Yes, you should have noticed, and so what, anyway?

    No, from what you say, she is well shot. And, since this obviously isn't the right kind of living situation for you, you are too.

    After reading the post I too am surprised about how you have treated her home. Remember that this is her home, and the other people were there before you. Just because there are towels around it doesn't give you the right to use them. Just because the kitchen is there it doesn't give you the right to leave it in a mess for other's to clean up. Do you have to take 1 hour in the bathroom....couldn't you do the rest in your room / elsewhere or at a different time. And all the rest.

    When you rent a place you rent the room / house. You do not also buy the right to all of the rest of the things you mentioned. You are 'sharing'....so you also have to think of everyone else in the house and contribute as necessary to various things. Its how it works. Its called respect and consideration for others.
