Thanks, Dr_A. I had notice that 2Birds had applied to the Court for a hearing to set aside the case because of the upcoming hearing in, I think, Liverpool, or it may have been the Dutch case. Sorry - I can't remember which. They claimed that the decision in that case would have a bearing on my case.
Unfortunately I don't have any experience of courts and didn't realise that I could attend the hearing to object to the case being set aside and therefore the stay was granted in my absence. It was about at this point that I decided to pass the case on to Bott & Co!!0 -
...........I then passed the case on to Bott & Co as I got bogged down in the reams of "evidence" supplied by 2Birds. So just waiting for Jet2 to pay up.
Thanks to all on here for their continued help. :T
Congrats, and well done for chasing this up, with the help of Bott & Co.
I wonder how many have walked away at this stage? The DIY route is certainly possible but not at all easy. Although from what you say above then it sounds like your case was stayed not set aside, a set aside is normally to set aside a previous Court judgment. After reading PtL Vaubans Guide , please don't desert us, hang around and help others!
Hi, we’ve had to remove part of your signature. If you’re not sure why please read the forum rules or email the forum team if you’re still unsure - MSE ForumTeam0 -
Almost certainly stayed as NA says. Note that the cases mentioned have now all been found in favour of the claimants. The DiY route certainly requires a claimant to be well organised and have a degree of brass neck in the face of complicated, if erroneous, legal arguments!
Given that the door has now been kicked fairly wide open, I also wonder how many passengers are not told of their rights/ have them denied by airlines?0 -

Apologies - yes - the case was stayed, not set aside.0 -
Hello all - I opted to go as far as possible with my complaint via Resolver. Generally their advice and feedback is quite prompt, however I don't think it works all that well if the company (Jet2) fail to respond at every step.
Anyway, I've taken my case to and received a response from the Spanish Authorities, finding in my favour, largely because Jet2 again failed to respond to them.
So my question is how best to proceed from here? There doesn't seem to be a template letter or any advice for this step - it's just take it to authorities-if Jet2 fail to accept take them to court. Is there an in between step whereby I contact them to say the Spanish Authorities have found in my favour and ask them again to accept and settle?
Any advice would be gratefully received.0 -

Thanks very much - LBA sent today via recorded mail and email.
Assuming they'll just ignore as they have everything sent to date.0 -
If you have constructed the LBA carefully, which I am sure you have after reading Vauban's guide, you will be hearing from Jet2. These days it's likely they will hold up their hands. If not your case sounds good enough to issue proceedings..0

I would report their inaction and repeated lack of response to the CAA anyway. If you're new. read The FAQ and Vauban's Guide

Yep.
passengercomplaints@caa.co.uk
And ask for it to be passed to the enforcement team who should look into it for you. Although you might want to see j2's response to the NBA before doing that.0
