Does the agent have to provide the landlord and landladys address in writing not just verbally?
Also I have a feeling he might say he cant meet for a check out on Sunday because he turns his phone off after 6 at night and the weekend, he just cuts off so no matter what kind of emergency happens he wont know till 8.30 Monday morning. What if he says noThanx

Does the agent have to provide the landlord and landladys address in writing not just verbally?
Extract from Landlord and Tenant Act 1985.
1 Disclosure of landlord’s identity
(1)If the tenant of premises occupied as a dwelling makes a written request for the landlord’s name and address to—
(a)any person who demands, or the last person who received, rent payable under the tenancy, or
(b)any other person for the time being acting as agent for the landlord, in relation to the tenancy,
that person shall supply the tenant with a written statement of the landlord’s name and address within the period of 21 days beginning with the day on which he receives the request.
(2)A person who, without reasonable excuse, fails to comply with subsection (1) commits a summary offence and is liable on conviction to a fine not exceeding level 4 on the standard scale.
Address is defined by the 1985 Act as a person’s place of abode or place of business or, in the case of a company, it's registered office. As said before in post #28 this is different legislation to that covering address for service of notices where an agent's address can be used.0 -
The agent signed for the letter this morning himself as it shows online the electronic proof of signature so thats good, he has not replied to arrange a time for check out visit yet though as daughter said to please contact so they could arrange a suitable time for that day. Not sure whether he will just ignore it just to be awkward or if hes trying to find a way to stop her. If he does ignore it though she will still vacate the property on the dayThanx

Agent texted my daughter saying he had 2 people wanting to view the house and could she contact him to arrange it, he did not mention the letter. He then rang her 2 minutes after the text and typically him was very smarmy, this will probably be because he has now realised he cant do anything about her moving out and he wants to get new tenants in asap. He then said I got your letter by the way and that is fine but can we arrange a different day as I don't work weekends :rotfl:she said no she couldn't as it was her only day off, I suppose she can sort that with him when the house is being viewed as he will be there.
He never mentioned the request for the landlords address and he's only aknowledged verbally that hes recieved the letter, but maybe it might be enough to concern him to just pay the deposit back to her without a fuss. It seems there may be a glimmer of possibilty that he could well turn up on Sunday and hopefully all will go well, fingers crossedThanx

i would make your daughters agreeing to allow viewings (she does NOT have to agree to any viewings legally) conditional on him putting into writing whatever it is you want in addition to him doing the checkout on the day to suit you.....
She is after all a Very busy woman !!
even better - only agree to a viewings on the day your daughter moves out .. then he is there to do the checkout.....0 -
She has already agreed the first one, for tonight I think and may even have arranged the 2nd. I thought she had to allow viewings, she doesnt really mind anyway. Perhaps she should text him before the time though to ask him to bring it with him on the first viewing and if he doesnt, then ask him to give it her before the next one. Although shes moving out in a few days so if he had to delay any vewings till after shes gone its not that long for him to wait. I'm hoping he just gives her the deposit as that will be the end of it.
I will be re checking the deposit schemes on Friday though just in case hes protected it this late, because of her asking for the landlords address. I didnt check under the landlord or landladys names before though, just the agents name and property and daughters name. So just in case they have protected it themselves I have to check that too
Good idea about the viewing on the moving out day, she could try to fix it for that too, although if the first one is already arranged for tonight she will keep it at that I think, shes the type that would consider the people veiwing it.Thanx

she should be looking after her own interests - not those of complete strangers.....
any agent who says he does not work weekends is an utter idiot... i bet 90% of removals happen at weekends....

i think you are being terribly optimistic.....
she needs to leave the property in tip tip condition and take a lot photographs - even if she has an inventory - these will asisst in any court case you may need to issue in the future.0 -
There is no inventory though, I don't know if that could go in her favor or not but the house will be left in better condition than when she moved in and she does intend to take lots of pictures and have witnesses. I will check with her later about the veiwing arrangements she could change them I suppose. But I want her to actually ask him if hes going to bring the deposit with him at the check out visit to give to her to see what he saysThanx

If there was no check-in inventory the landlord is going to have a very hard time indeed in justifying any deductions whatsoever from your daughter's deposit. She should ensure that she takes dated photographs of everything, including carpets etcetera in addition to witnesses. I have a vague feeling that your daughter might have to fight tooth and nail to get her deposit back so she should plan for the worst-case scenario0
