    I too have been fighting the BOS. Nearly 7 months now ( 1st asked for statements on 16th January! )
    FOS have had my paperwork since 15th June, so hopefully it won't take too long and will bethe right result!!

    just read your last few advise comments, need some help myself also? I have gone through all letters for reclaiming charges and I have also now gone down the FO route, out of 5 different claims so far one has been successful eg claim against halifax (IF) for £248.50 and settled just last week for £216 (inc some interest) and this was mainly due to the intervention of the FO. However, I now have claims against nationwide, Alliance & leciseter, monument and Egg. The FO have now passed all these claims onto different investigation teams and in some cases they are now waiting on the companies getting back to them, but I received a letter from FO today with regards to my claim against Egg. I originally claimed for charges amounting to £253 (inc interest) but FO have came back saying that Egg are still disagreeing (as previously they offered me £40) with my claim. Egg's main reasoning if that they reduced their £20 charge to £16 and are therefore offering me the £4 difference (eg £4 x 10 charges of £20 ). FO have asked Egg to increase offer or provide them with info re level of charges and how they were calculated, what does this mean? there is also mention of OFT findings relating to credit card charges and FO are not aware of any court rulings regarding illegality of credit card charges, help? now really confused

  • Hello, like the masses I'm trying to reclaim charges from the Bank of Scotland for a current account and a credit card.

    Two questions:

    1. In the initial letter asking for all that I have been charged, can I include both accounts on the letter which requires the £10 maximum statutory charge? Or should they be separate letters/claims?

    2. Upon receiving this information in Scotland would I be right in saying that you can claim 5 years back and most importantly only up to £750 - per account or maximum payout?

    Hope somebody can point me in the right direction ;-)

    Lots of help in this thread! First of all one letter, one cheque for both accounts. Do ask for 6 years of information/statements as the five year limit is if you put your claim through the court.

    As you can see from this thread, should your claim be more than £750/£1500 you will be better putting your claim through the Financial Ombudsman when/if it reaches that stage.

    This is very good news for you as Egg won't reveal to the FO how they calculate your charges and also the OFT ruling is a recommendation and not a court ruling which the FO have pointed out to Egg.

    Sit tight and wait, the FO are playing a blinder on your behalf.
  • I apologise in advance if this question has already been answered, but I've done a few searches and can't find an answer. I'm claiming around £2500 from RBS, and my overdraft is just over £2000. I'd be happy with them closing my account with a zero balance. Can I use the standard "without prejudice" letter to make them this offer, or is it different up here? I've received the 6-7 weeks letter, and not quite sure what my next move should be.
  • Ive worked out i need to reclaim approx 6000 from the clydesdale but i cant work out from all the message whether i will get it as im in scotland.

    what are my chances ?
