Do what I did and demand compensation! Contact the Financial Ombudsman and complain to them. Also tell Barclays that they owe you another £230 for self litigation

I sent my step 4 letter, threating court action 14 days ago and have no response, but am I right in thinking I can't claim anymore than £750 in small claims court in Scotland? Should i go to FO then?:rolleyes:0

Since then i have received a lump of letters from Barclays...My account is currently over the agreed overdraft limit set, due, in the main, to charges exceeding £150 some months.
I did the advised setting up parachute accounts and have transferred my banking elsewhere, however Barclays have issued letters of termination of the account as well as demands for the full repayment threatening court action and credit blacklisting if i do not comply.
I am now at the stage of either going the FOS or the Courts...as they have not responded in the 14 days.
How can i prevent credit blacklisting or any other threatened action while this is resolved?
I live in Scotland although my Bank is in Brighton England (long story!!) ... and i understand that the court method up here is not as easy as down south.
Any advice here is massively appreciated.

Mainly because you live in Scotland you really need to go down the Financial Ombudsman route because of the amount of your claim. Please have a read of Martin's article regarding using the FO and you'll find in this thread and in the thread I've linked to above that many people have had a worry free claim via the FO.
I would also tell the FO about the letters you have had from Barclays re your account.0 -

What is the situation if your account is sold to a debt collection agency. Barclaycard made me an offer of partial repayment of charges, which I accepted. Today barclaycard telephoned me to say the repayment had been sent to Max Recovery who had bought my debt from Barclaycard. 18 months ago I reached an agreement with all my creditors, including Max Recovery, to settle my debts through a Trust Deed. Are Barclaycard still obliged to repay me charges incurred on my account before I defaulted?0 -
You need to have a read of this thread regarding a claiming on a closed account with a DCA.

Generally the banks will repay any monies reclaimed into the account that it has been claimed from, even if this has been passed to a DCA.0 -

Just sent away a claim in excess of £2000 in bank charges to HSBC in England.
Can anyone tell me, If I need to threaten court action, would I do this through the Scottish or English court system?

Please help! I have been firing off letters to the TSb since March and have had no acknowledgements in writing at all. 15 days ago I wrte threatening court action and I've just called my branch and they told me to go ahead! I dont know how to do it! Can anyone help. The moneyclaim online site is for England only. I'm claiming £2300 in Scotland. Please help they are so arrogant and I need the money so much. I cant roll over and take this!0

Theres no info in Martin's material about this! The only info he provides is details about the small claims system in Scotland but thats only for claims up to £750! Please help, I dont know how to take the action I threatened which is going to court.0
