Using CCTV evidence against Atos....

Hi, my dad failed his assessment for ESA and the report was full of lies. The main lie in the report was the duration, so what I did was to see if I could get CCTV footage of me and my dad leaving the building in a taxi. After nearly 3 months I have got footage from
The council camera on the street of me and my dad leaving.

The nurse has added 35 minutes to the medical, which
Makes the rest of the report void regarding how long my dad sat in
The chair etc.

I just want advice to the best way to complain. Should I
Be going directly to atos or dwp or both. I will be visiting my mp etc as I do believe this nurse should not be doing medicals. My dad has not received any money since the medical.

  • How did you manage to obtain the CCTV footage? I might be wrong but I didn't think council's were allowed to give CCTV footage out, unless it was to the police etc.

    if your being recorded on CCTV you do have the legal right to ask for a copy of it / to see it, its been like for over 10 yrs, when I worked in my job it was between 2000 and 2002, that we had to display signs saying the premises was being recorded, and who to speak to see regarding it. In this day and age CCTV is just taken as norm, so its not a publicied fact that it can be viewed.
    The only snag can be is whether the CCTV has actually been recorded, and how long the company concerned keep them for before recording over,

  • I parked my car in Asda last year and came out to find some idiot had dented the front wing, went back in Asda and asked them could they look through the CCTV for me, they did but then said....if anything shows up on it you need to go to the police, we can only pass it on to them. Maybe it depends what the CCTV is being used for.

    Anyway I digress....

    ASDA are being annoying idiots. They probably suggest that as handing over the entire tape... which would infringe others privacy etc. They trust the police, not you.

    I would get all the requests in asap if you want the copies of the tapes / or for them to hold on to them, we had a near miss in the carm when the other driver came out of a car park and proceeded to cross 3 lanes of traffic, we braked to avoid an accident, but needed the CCTV as proof, by the solicitor got hold of the council - they had erased the relevant CCTV!

    Have you got anyone ealing with the case, if not I would suggets speaking to the CAB and they can put u in the right direction.

    I have no idea on how to use the CCTV but well done for sticking up for your dad. There seems to be far too many incidences where Atos have lied. Good luck with it.

    Would it not have been far simpler to have asked the taxi driver to give you a receipt which stated the pick up time?

    You have a right to any footage that a CCTV camera has of you. The company which own the camera can charge you a reasonable fee for this.

    I already have the footage. I just want advise how to go about complaining has the nurse who did the report should not be allowed to do medicals. Thanks.

    This is Atos. You need proper evidence.
