Using CCTV evidence against Atos....

    It seems the OP has irrefutable proof that the nurse put false information into the system.

    Either she made a mistake (as she will no doubt claim) in which case she should get a slap on the wrist or she deliberately lied in which case she should be struck off.

    Thanks. I hope she gets struck off and they review her previous assesments. I would never wish this on anyone that someone loses their job but shes treated people badly and her job is to help people who are Ill. The thing is how can she say it was a mistake when she writes in the report my dad sat for 40mins when we were out in 30 mins etc.

    Hi. I don't agree with that at all. When I worked for Victoria Wine, people would sometimes come in wanting a copy of the CCTV footage for one reason or another. Mainly because of what had happened outside in the street or parking area.

    There is no way these recorded images would be handed over just like that. There is protocol to obtain this. I think it is known as a Data Protection Act request.

    Asda are not being "annoying idiots". They have procudures to follow and a responsibilty to protect themselves also.

    Did you formally appeal the actual decision using a GL24?

    That's what you should have done - whether or not the ATOS nurse lied about duration will have little impact on your dad getting his benefits reinstated.

    They are two seperate issues -if a medical practitioner acts inappropriately, then that is matter for the GMC and ATOS complaints procedure, not the DWP decision makers, although of course complain to them and your MP as well - these dodgy EMP's (HCP's) are a menace...:mad:

    Your dad needs to get some welfare rights help with regard to his benefits, so I would contact the CAB for some advice:

    I might be wrong but surely if she has lied about the duration the report is wrong. Because she says my dad sat for 40 minutes in a chair etc and stood for so many minutes etc when we were only in there for 30 mins. And these are the things the decision maker makes the decision on.

    The CCTV is much better as evidence. A receipt from a taxi driver doesn't necessarily mean that the person attended - he could have just been picked up from there.

    Did he maybe sit in the waiting room for ten minutes and the assessment room for thirty minutes?

    This is meant to be a serious answer to your question, as it is quite a serious thing to try to get a nurse struck off the register. You need to look at all the options, and make sure there has been no misunderstanding.

    Also, and sorry if you have stated this elsewhere, have you tried the appeals procedure?

    Firstly get LOTS of copies of the tape.
    make a formal complaint to ATOS Your MP and also the police as this is possibly fraud commited by ATOS, at the very least it is deception, ask for charges to be brought aginst the individual who changed the time period or even consider a private prosecution against them.
    It could also be worth sending copies to BBC Watchdog and the newspapers. hang the scum out to dry.
    Despicable practices.
    The DWP = Legally kicking the Disabled when they are down.

    They are proving that the nurse lied significantly and they're doing it very well too, simple and categorical proof. That certainly does not imply they have something to hide at all.
