Was in a Car crash Accident today involving 4 cars?

The driver of the Toyota celica crashed into my car which caused him to lose control crashing into the other 2 cars parked on the street. The owner of the 2 parked cars just happened to be outside when it happened.


The Toyota driver admits liability because I have right of way however he didn't give me his full details and he phoned his girlfriend and hes girlfriend arrived few mins later and she said its insured in her name. She just gave me her name, mob number, address details however she never gave me her insurance details cause she says the policy documents at home. she just said shes insured with churchill


Police turned up but by then they drove off however police gave me the copy of the log record and took my statement.


How do I claim without losing my no claims bonus?


Do I phone up Churchill and give them the reg number of the Toyota or do I phone up my insurance and they will do all the chasing for me.

    So I just give Churchill the reg number of the Toyota and that will bring up all the insurance details of the female policyholder? Churchill wont say rubbish like data protection laws cant share information of policyholder?


    Will Churchill pay out for my car cause her boyfriend was driving her car that wasn't in his name? The girl is liable because she gave permission for the boyfriend to drive it unless he stole it? So how does it work and who's liable and is Churchill responsible for a situation like this?

    Not if you speak to their third party claims department.

    There's no reason not to go to your insurer. You will need to inform them about the accident so you may as well get them to deal with the claim for you. They'll be able to get on with repairs and put you in a courtesy car straight away, whereas if you try going straight to the other insurer you won't get anywhere until they've established liability.

    You're not asking them to give you information about their policyholder and so there is no data protection issues.

    Just because the policy is in her name doesnt mean he isnt a named driver on the policy. Assuming he is then everythings fine and the claim progresses.

    If he isnt a named driver then things are going to be slower as Churchill will first want to ensure he doesnt have Driving Other Cars cover on any policy he personally holds with them or anyone else.

    Assuming he isnt a named driver and doesnt have DOC cover then Churchill would still be the Road Traffic Act Insurer of the vehicle meaning they have an ultimate legal liability to settle any claim (and a right of recovery from their insured and/ or the driver). Some insurers take this obligation on easily/ quickly and other than possibly slowing the claim a little it makes no difference to "you". Others will insist you go the long route and get judgement against the driver first.

    In the first instance call Churchill and advice you are the non-fault party in an accident with one of their policyholders and you wish to claim directly from them. Assuming the claims registered it'll all be good from there. If the claim hasnt been registered they may take the details over the phone from you or may insist you put them in writing to them.
