Was in a Car crash Accident today involving 4 cars?

  • What you need to do is the following:

    1- Call Churchill and report the claim to them, give them all the details you have and tell them you are TPFT cover and want to claim from them and that if they don't sort you out, you will be going with an accident management/ credit hire company. This should hopefully encourage them to take you under their wing.

    2- Report the incident to your insurers "for information purposes only". By doing this, you comply with the requirement to notify your insurers of an "incident". As you have TPFT cover, you can't claim off your own policy.

    3- If Churchill look after you, then there is nothing else you need to notify your insurers of. If Churchill are not playing ball, your own insurers may be able to refer you onto an accident management or hire company even if you don't have legal cover as they will still get a kickback from the hire co for doing so.

    Follow those steps and it should all be good. If there are problems then come back and we can advise further. At the moment there is lots of talk of "this could happen and that could happen etc", which is just confusing the original poster.

    You need to read the whole thing, if she doesnt assist the police then it'll almost certainly be considered that she is complicit with the incident and thus its not treated as theft but an authorised uninsured driver, her vehicle is uninsured, Churchill settle the TP claim and pursue her for the money.

    There is a small risk that Churchill will demand a judgement against the driver but it shouldnt be too hard for it to be worked out who her boyfriend is.

    Back in my claims days we had several of these sorts of cases, from the other side, fairly often though more commonly it was the son that had taken dad's car and our approach was straightforward. Press charges against your son and its theft, we repair your vehicle and we pursue your son for all our outlay. Dont press charges and we will consider it authorised, we wont repair the car, we will void your policy and we will recover our outlay on the third party from you

    I'm dealing with the OP's questions which revolve around the civil matter of insurance. What the police will do about the possible criminal aspect isnt my area of expertise

    Im just stuck on whether to go to the Accident Management Company or do all the work myself by going direct to Churchill.


    I doubt Churchill will be legally afraid of me and say get lost to me but I bet they be afraid in men in suits and ties (solicitors) from accident management company asking for costs.
  • All you have to do as far as "doing all the work yourself" is concerned is phone Churchill, if they don't say they will sort you out by end of Monday, then just go to an accident management co.

    The threat of a TPFT third party who can't claim off their own insurance means the claim is almost certainly going to land back at their feet, so they may aswell roll their sleeves up now and help you whereby they can control the costs of the claim by making their own hire arrangements at a cheaper rate, rather than the much higher rate a credit hire company will charge.

    There is no more work involved in phoning churchill to phoning an accident management co.

    Update: The female policy holder has registered her claim with churchill this morning. She told them she admitted liability and she gave me her claim reference number. So i guess its sorted then?

    She's lying about who was driving...? That says everything about his insurance!

    I would say that you still need to make sure Churchill are aware that she wasn't the driver and that it was in fact her boyfriend. It sounds like she is trying to cover up the fact that he was driving her car with her permission but without insurance.

    I had an incident where a neighbour hit my car whilst he was driving his mums motability car. I went straight to his mums insurers and they got my car fixed AND provided me with a courtesy car within a couple of days.

    I think Churchill will be more accommodating than you give them credit for, partly because you're panicking about your own no claims. Just speak to them and you're fine.
