    Hasn't the TP driver committed an offence anyway by not exchanging details? AFAIK it is an obligation on the driver's part to do this, not necessarily the owner of the vehicle.

    As the driver hasn't correctly exchanged details, isn't the OP obliged to report the incident to the police within 24 hours? Or did the OP already make the police aware that he/she was not provided with the driver's details?

    I think they would be best to sort their claim first. The police report has already been completed.

    Committing is usually covered on sdp.

    This isn't the OP's problem. The TP's insurers have a legal obligation to deal with the OP's claim irrespective on whether the TP was complying with the terms of their own insurance policy.

    Under certain circumstances they don't have any legal obligation to deal with a third parties claim.

    The uninsured driving using the vehicle for a use not covered is one of them.

    You can be sure an Insurer will not pay out a claim under their RTA obligations for an uninsured driver if they're not legally obliged. In such circumstances the claim would be passed to the MIB as an uninsured driver claim which would take a long time to receive payment
