Phone has packed up 16 months into 24 month contract (Orange)
Hi all, my HTC Desire HD has died on me - it said it was charging but then the battery runs down really quickly for a few days. Then in the past couple of days it kept on telling me it was using more power than the battery had, switch off an app, then it started shutting down and was difficult to switch back on, and on Friday it switched off and I haven't been able to restart it.
Obvs its more than a year old, I don't have Orange Care, and I haven't approached Orange yet. Just wondered if anyone had any experience or advice in getting a repair at this stage of the contract free of charge or whether I am up !!!! creek without a paddle. Thanks!
Edit: Found a forum where an owner with a 15 month old HTC Desire on Orange had to send it to HTC, although they claimed it was water damaged and refused to repair...

CarPhone Warehouse website say phone has 2 year warranty!

What CPW site says is about the warranty they give to the phones they sell. The manufacturer's warranty can be different. E.g. it's 12 months for Blackberry, not 24.CarPhone Warehouse website say phone has 2 year warranty!

However, it is the same 24 months for HTC.0 -
Hmph. Orange don't want to know after 12 months. I have just e mailed HTC but will contact Orange as well.
Edited as cross posted: thanks, I have e mailed Orange as well, will insist that one of them looks at it with a view to repairing. Blasted thing.I have had many Light Bulb Moments. The trouble is someone keeps turning the bulb off

Don't waste your time on Orange unless you are prepared to sue them.0

It's out of warranty with Orange so why are you wasting your time with them when it has an HTC warranty?
Orange have no responsibility to do anything now.
However, if it's battery failure, that is not covered by either warranty. No free lunch, and no free laptop

Warranty complements the statutory rights, not replaces them. It's out of warranty with Orange so why are you wasting your time with them when it has an HTC warranty?
They do have under the SOGA and SOGaSA if they sold the phone.Orange have no responsibility to do anything now.
It is, but the warranty period is likely to be shorter. However, if it's battery failure, that is not covered by either warranty.0 -
disposable are what batterys are classed as, the max warranty is 6 monthsDon't put your trust into an Experian score - it is not a number any bank will ever use & it is generally a waste of money to purchase it. They are also selling you insurance you dont need.0
-
Batteries as 'consumables' (not disposables) - a subtle difference. SOGA is unlikely to apply unless it blew up whilst charging, as misuse can cause loss of capacity in use (and clearly not covered)0

But why would the OP go down the SOGA route if it's still in warranty? Orange would only have to send it to HTC anyway if a repair is required. No free lunch, and no free laptop

I don't know why and this is absolutely irrelevant. May be they just want not to pay for the postage if HTC don't offer a free collection. But why would the OP go down the SOGA route if it's still in warranty?
It is not the OP's problem how Orange fulfil their obligations. They can repair it, replace it or send it to HTC.Orange would only have to send it to HTC anyway if a repair is required.
And was it not you who said:
?...Orange have no responsibility to do anything now.
This is the same lie that Orange keep saying their customers when trying to fob them off.0
