  • if MBNA are defaulting my cc next month does this mean they won't be accepting my pro rata payment offer then ? the 'account manager' who has been assigned to my account is extremely rude and negotiations with her have proved to be extremely difficult..she claimed I was 'wasting her time' the other day  i am finding it more and more frustrating dealing with them..they seem to hold all the power...ugh.

Keep sending your pro rate payments MMD, when they default your account it just means that they are recording the fact that you are not keeping to your side of the bargain and paying at least the minium payment. Once the account is defaulted they are quite often passed to debt collection agencies who are sometime more approachable than the actual creditor and tend to accept your pro rata payment. Keep making an effort to pay, however small the payment, it will show a court (if you get taken to court) that you are maintaining some sort of payment and giving the creditor what you can afford.
  • thanks so much girlracer...MBNA make it all sound like it's the end of the world if I don't pay them more more more money straightaway...I will maintain my pro rata payments as soon as I get my new bank account this week (hopefully!)

Goldfish and MBNA are CONSTANTLY ringing my mobile from 8am until 9pm EVERY SINGLE DAY weekends included.

If you haven't already asked them to communicate by letter only, do so. If they continue to call you, send them this - it's one of the templates that floats around this site:

    Dear Sirs,

    Harassment by telephone

    Account Number: XXXXXXX

I am writing in relation to the quantity and frequency of telephone calls that I have received from your company, which I deem to be personally harassing.
I have verbally requested that these stop, but I am still receiving calls.

I now require all further correspondence from your company to be made in writing only. Please remove all telephone numbers (or just quote the number at work) from your records, as is my right under the Data Protection Act.

If you continue to harass me by telephone, you will also be in breach of the Communications Act (2003) s.127 and I will report you to OFCOM, Trading Standards and The Office of Fair Trading, meaning that you will be liable to a substantial fine.

Please treat this also as a formal complaint, and send me a copy of your company complaints procedure.

Be advised that any further telephone calls from your company will be recorded.

    Yours faithfully,

Make sure you send it recorded delivery so you know they received it, and make sure you don't sign the letter. Type your name only.

Keep going moneymeltdown it will be worth it. The stress is going to be awful but once the agreements have been made the pressure will be off you slightly and the hassle from creditors will stop.

When my sister sent her pro-rata letter she also sent her token payment by cheque. When the cheque was cashed we then knew that the letter had been received. The only other thing I can suggest is to send another one recorded delivery then they can't deny receiving it.

Just hold on in there hun, it will get better. Pop over to the DMP Mutual SUpport thread, there are loads of knowledgable bods over there and they should help you feel better.
