    1) You accepted them when you fitted them and they worked. It was only when you tried to bluetooth it and knackered it that you decided you didn't want it and clung on to the soga like a drunk clings to a lamp-post, for support, not because it will do him any good in the long run.

    2) ice have offered to refund your money once they have been given chance to ascertain if indeed the goods have a fault that is not user-generated.

    3) ice are continuing to offer to refund your money once they have been given chance to ascertain if indeed the goods have a fault that is not user-generated.

    4) relevant facts are that ice will give you your postage back if, as you say, the radio is actually broken due to a design fault or mechanical breakdown or whatever, not because someone who didn't know what he was doing bodged it up.

    So in your first line you accept I had not had the chance to test all features? and you dare to libel me by stating I had damaged the device!!! not looking good is it?
    You have already stated you would not purchase from these people because of their T&C's, is there a lack of trust there?, if so then surely I must be right?

    Do you actually have any evidence of any of your statements after that? btw gossip is not admissible evidence

    I don't know whether you have damaged the device or not - nobody does unless you let ICE do what they have been asking to do for the last six months and, you know, LOOK at the thing!

    No, I wouldn't have bought from them upon reading their terms and conditions. Their terms and conditions were clearly laid out and, were I in the market for a car stereo, would not have been acceptable to me and I would have gone elsewhere for my product, somewhere where the terms were acceptable to me. But you didn't read the terms for some reason and in buying the item, you accepted the terms. Ignorance isn't a defence.

    I'll get back to you on the gossip question when I actually figure out what you're on about. :rolleyes:

    Well as stated TS said if the judge feels it necessary or if requested to by the defendants he can order an "independent" report. maybe it may happen in the first hearing as i suspect there may be more thatn one the way incarexpress are going about things.
    In the latest letter from incarexpress they said they would apply to have any hearing at a more suitable venue to them, when i passed this on to the TS guy he actually told me that a judge can then order a hearing to see if the actual hearing should be moved, i nearly pe'ed myself laughing!!

    as far as accusing read the line presented, with your "Legal experience and/or training" you should be able to tell us whether it is or not!
    As for TV analogies Mrs Bucket I really am nothing like Victor Meldrew although one thing we do have in common is a nagging woman with little substance constantly being a pain in our faces :rotfl::rotfl::rotfl::rotfl:
