Well I can't make head nor tail of the orginal post either. A little effort in posting goes a long way instead of lazy text speech. :mad:0 -

the lights on the other side had no feeders and if you look and there are cars stopped and the car that hit me wasnt in sight,
arnt i suposed to look in the direction i am going and not out the passenger window
as for witnesses if i wasnt in the back of the ambulance then i would have asked for their details myself
if the police are threatening to prosecute do i not get a more detailed explaination
and dont they have to disclose evidence to me or my solicitor
having no experience of this sort of situation i thought ai may get some help in here although some have helped others seem to be in here for a laugh
If you have the option of a driver awareness course then take it. No points or fine but will cost you for the course.
I am being prosecuted for the same, I was hit by an uninsured driver on the motorway. So far I have paid a £300 retainer to my solicitor £900 for expert witness report. My estimated legal costs are £1500 for solicitor + further costs of £98 per hour for expert witness testimony and half rate for travelling and waiting time + 49p per mile.
So if I lose about £2800 plus whatever points and fine they give me.I have a cunning plan!
Proud to be dealing with my debts.0 -
i have extra legal cover on my policy so i am fully covered on that side,
also from wot i have heard from the police they dont appear to have made a decission either way,0 -

So do I but it only covers private prosecution to recover uninsured losses, injury etc, not to defend criminal charges.
You may want to check with your insurer before running up charges.I have a cunning plan!

this is the thing my solicitor thinks some where along the line they havnt visited the seen or something is missing or over looked from the report
and why would i take a driving course that admitts to them that i am guilty i thought it was supposed to be inocent until they prove otherwise0 -

Yes, this is correct.
The motor policy itself will offer some level of criminal prosecution defence, but only if the insurer agrees to pay for it. Of course, they will only pay for it if it is in their interests to pay for it, i.e. if the prosecution could prejudice their position in terms of a related accident, and you have a reasonable prospect of being found not guilty.0 -

Did the lights facing you have a right turn arrow, or just a regular green signal. If the former, then I think you've got a reasonable case, although in principle I'd say you should take adequate observations bvefore completing any manouvre. If it was just a green signal, then you didn't have priority, and I'd take the course.
To be honest, I'd take the course anyway to be on the safe side. Whether or not you were at fault, I doubt there's anyone here that couldn't improve their driving a bit.0 -

What?? Surely you are forgetting the poster who is a shining example to us all:I've spent the last 15 years doing up to 2000 miles a week all over the UK and haven't been caught.
I have been providing assistance, including Lay Representation at Court hearings (current score: won 57, lost 14), to defendants in parking cases for over 5 years. I have an LLB (Hons) degree, and have a Graduate Diploma in Civil Litigation from CILEx. However, any advice given on these forums by me is NOT formal legal advice, and I accept no liability for its accuracy.0 -
