We bought the house off plan and were told by the sales advisor that power would be in there. We even had a discussion about the gym equipment in there! I cannot recall whether we signed the electric plans for the garage or not. My solicitor suggested writing to them as they would not appreciate any bad publicity and trying to come to a compromise. I think that is probably the best option now.
Get a candle and some dumbells. You'll be fine.0 -
I would say that the term "applicable" is still key and NOT a get out. They should have used "available" rather than applicable.
It is applicable that the garage should have power.
I'd say you could force them to install a cable - after all easements frequently exist to allow the servicing of pipes and cables.0 -
Rothers - What a screw up by the builders? I think the only thing you can do is to keep pushing and get some other compensation from them. Their lawyers have used the term "applicable" to mean "that which can be applied". And they are now saying that, in this case, it "can't be applied."

Legally you probably don't really have much of a case. And anyway are you going to go through a protracted court case wih the epense pressure and uncertainty that it entails.
Practically just tell them to get on and install the electric. Wht can't it be done anyway? probably too expensive so they can't be bothered. IT CAN be done!! Ask them for a site visit so someone can eplain/show you why they can't do it.

Are there any other properties closer to the garage that already have electric that you could tap off for a small fee?
They could just have the electricity board take it from the street and put a separate meter in. They will fight tooth and nail against doing this because it will cost a bit and involve a lot of hassle.0 -
dont take it lying down. make them pay for it if they cheat on you.
here is what i would do in your situation- maintain a logbook of all events. this might be useful for complaints and legal action if needed
- record all phone calls where you discuss the issue with the builder or solicitors etc using the following methods
- people who have been given wrong advice by builders etc might want to record their discussions with them. there is no need to inform them that you are recording the conversations (subject to few condition, see link)
later you need proof that you called them if you need to proceed legally. check your phone bills for those months when you made the calls. if you dont have them try to get a copy from your phone company. and probably u can use that as proof.
when ever anyone calls regarding legal issues etc, please make a note of that on your phone bill. it may be of use in the future.
also see the article in the independent newspaper on the 17.10.2007 about how to record phone conversations. it will be useful for having a record of the conversation for legal purposes.
in the uk it is legal to record phone conversations as per the article. we are allowed to do so for our own personal use, without telling the other party. this is confirmed from the information commissioners office and that this can be used legally as proof of a complaint call etc. but it says that in general if you play such recordings for 3rd parties then you need to have consent of the other person.

i feel it is worth investing a few pennies to record the important conversations and the websites send you a audio file in different formats of the conversation. or you can record you own conversation by buying the equipment
hope this helps a few to keep a record of their discussions with the builders or the legal representatives etc and use those discussions as proof in case of future problems if their advice was wrong. better to be safe than sorry. - use the same logic for recording conversations on visits to the builder to sort this issue. buy a good voice recorder which is small and discrete and has got a powerful mike and use it to gather proof in discussions
- also if it is a garage there will need to be access to the garage. so that access includes for vehicles and amenities like electricity. insist on them providing it or say that you will take them to court using no win no fee lawyers. look out for lawyers if you dont want to lose money when u sell the house later for the garage not having electricity
- also mention that the garage is unsafe. health and safety issue. u will need to use the garage at night. that needs electricity to use the garage safely. so see if you can report thois builder to trading standards or any body that deals with builders
- see if he has signed up to an ombudsman scheme and use it for redressal
- verbal contracts can also be enforced as per uk laws. see if u can get witnesses for the assurance u got. see if the same happened to others who bought houses in the development. gang up and hire lawyers.
- all in all, make enough trouble, so that it is cheaper for builder to give connection rather than fight with you. make sure u dont break the law in the process
- also tell the builder u will put out signs outside ur property when you move in that, the builder cheated you and assures electricity in garage when selling but doesnt later. this will affect future sales in development if he has got other houses to sell there
- take proper legal advice and dump that solicitor who didnt already tell u about these options.
