Why is there such an imperative for him to leave? You both have joint ownership of the house,you both have an equal right to reside there, you both have children together. Why not just have a conversation,agree that the relationship is over and just share your joint asset?

the simple fact is, LEGALLY he has every right to be there, so to answer the original title of "OH won't move out"
answer is TOUGH.
if she can't handle it (and i'm not saying she should be able to or it's a situation I'd like to be in) she either has to give him some cash to find somewhere decent enough for him or she has to move out and find somewhere (and take the kids as well).
so if she doesn't have a little stash of cash, then she's gonna have to sell up.
i appreciate he doesn't want to be with her, but that doesn't mean he should make do living in a scummy bedsit either.0 -

Looby - I am in the same situation as yourself - and have been for over two years now!!!
You can claim child tax credits as a single mother, which means that you would not have to ask your Ex for money (mine would never give me any, even during our relationship). You are no longer in a relationship and the fact that you have to share accommodation should not stop you from claiming the full amount you are entitled to. However, if he is paying all the mortgage and bills, then obviously they will not count you as separate.
It can be a horrible situation to be in (I really resent clearing up after him, but he won't do it - even if I leave it), BUT it does mean my children see their Dad sometimes (I say sometimes as its my eldest's birthday today and his dad forgot and even when I reminded him last night he still went out and hasn't returned and is unlikely to until tonight!) That really bugs me as he says he stays for the boys!
Unfortunately, I am not in a position to move out, and he also couldn't afford to run a separate home (he's been out of work for a month now).
Loopy, try to get some separate areas in your house for each of you. I mainly have the living room and he the dining room - this suits us both. It is not easy though.0 -
Surely if you are the one looking after the children, you should be able to stay in the house until they have finished school
at which point you would have to either buy Ex out or move to another property.
My Sister is getting divorced - husband cheated for 2 years, & she is doing the above.
BUT - he is living there at the moment & they've been seperated for at least a year now,(she tried to make it work, for 2 years ) he hardly does anything to help around the house, & makes it really awquard (sp) to have friends around as he just sits there. when he's had family around, my Sister does the decent thing & goes out.
She actually can't stand him, but is civil, so even the suggestion that they may stay in the house & live seperate lives would be awful.
I really feel for you, it must be terrible to still love him & have him there still - he is being very cruel IMOComping again - wins so far : 2 V festival tix, 2 NFL tix, 6 bottles of wine, personalised hand soap, Aussie miracle conditioner :beer:
