Hiya mummy,
My dh is self employed, works from home, no overheads as such, just a profit/loss sheet for last years income. This was fine for cccs, no problem at all.

Hi All I am in a little bit of a mess at the moment. Between my wife and me we are 37K in debt to 13 creditors including 3 overdrafts. We are in the early stages of setting up a DMP with CCCS through the National Debt Helpline (who are angels in disguise). I have sent the pack off to them and have the gesture of goodwill letter ready to go.
I had a woman turn up at my door unannounced from black horse last week. I didn’t answer because I didn’t know where I stood talking to her because the NDH guys told me not to talk to anyone and ask them to put it in writing. I spoke to them again and they told me she shouldn’t be calling unannounced and this could be classed as harassment. She called again yesterday and I answered the door because I didn’t want my wife to face this if she has a day off in the week. When I told her about calling unannounced and harassment she told me I was wrongly advised. She asked me if I still have the car and I told her I don’t want to talk about it. She told me she will be starting proceedings to recover the car and I was being foolish by not talking to her and they will refuse any offer from CCCS. My wife is now buckling under the pressure about the car and wants to try and pay them (which we haven’t got and will make us worse off) what should we do?0 -

Our first DMP payments are scheduled to go on 1st Nov. Today we had a very snotty phonecall from HSBC who said they will refuse to deal with CCCS as they do not deal with 3rd parties. He said any offer we make will not be acknowledged.
Has anyone else had his from them? Can they do this?

Hi All,
Some advise needed please.... we're on our DMP with CCCS, first payment made 1st September.
Our safe bank account is with Lloyds
We have CC debt with Abbey
Our mortgage is with Abbey and we used to use an Abbey current account to transfer money each month to cover the mortgage payment. We now pay this directly from our Lloyds account as we didn't want Abbey grabbing the mortgage payment from that current account.
However, the month before we stopped using this account (I think July time?) we went overdrawn by about £5, as we usually overpaid a little and used the surplus as a top up emergency piggy bank. Unfortunately my OH made a switch payment without checking how much funds were available.
Due to the charges that they made for this and then charges on top of these, they're now demanding £135 immediately, which excludes any pending charges :eek:
They've been charging over £55 per month...
As I'm on a DMP, I do not have £135+ spare to give them. So should I...
1) Beg and borrow the money to pay them
2) Add them to my DMP
3) Contact them to try to come to a payment arrangement
4) Contact them and say "we can't pay, we're a DMP, we'll pay the original charges if you agree to cancel all subsequent charges, but if you won't do this then we'll add you to our DMP and you'll get £5 per month"
5) Any other suggestions?

Hi,
I haven't dealt with HSBC but a lot of creditors act this way. Very snotty and unhelpful. From now on tell them only to communicate in writing. Continue to keep CCCS up to date and if you feel the need send HSBC letters stating what you said before including your CCCS reference number. Hopefully, once you have made a series of payments they will begin to realise that there is no more money in your pot. Yep thats HSBC to a tee, the most unhelpful company on the planet! Their literature actually recommends you contact CCCS yet their little minions (I actually use to be one 8 years ago!) will say they wont deal with CCCS to get you to deal with them only and then make a bullying tactic galore play to get all of your surplus money rather then have you be making equal payments to everyone! Just stick to your DMP and CCCS will just continue making the monthly payments to them irrespective to the fact they have not acknowledged the offer.
Do not speak with them at all on the phone. I would recommend removing your telephone number from your internet banking profile (as that made the calls stop for me) and unfortunately you just need to ride it out till they eventually default as they will rarely accept most repayment offers it seems.
I use to be a quivering crying mess everytime they contacted me, but eventually a switch flicks and you see they cant have what you dont have to give. I am actually in the process of sending them complaint letters about their process of refusing to cancel the loan Standing Order when they know the circumstances of their customer and they are further increasing debt (more for my own satisfaction as I know it wont change anything as they are like a broken record) The latest one made a point of quoting OFT debt recovery guidance that states unfair practices include refusing to deal with an appointed representative and bypassing said representative. Also mentioning that they should follow the 'correct collection proceedures' that they keep threatening as I really want the account defaulted and passed to DCA (least then the debt will get fixed and stop increasing in theory)
Bit too much waffle there but my disrespect for HSBC as a result of how they have dealt with me knows no bounds0 -

They did say the account will be defaulted in 2 weeks which I suppose is a good thing? I've been banking with them for over 20 years and did feel some loyalty. I don't know why as they have constantly charged us, we've paid huge amounts of interest every month and they would rarely refund overdraft fees even if we'd only gone over by a few pounds. I am worried they will take the cc payment from the overdraft though. It's up to its limit already so could they keep taking money and incur more and more charges?

Also, where in their literature do they recommend contacting CCCS? I'd just like this to hand when they keep badgering us!

In the circumstances I would add them to your DMP. You need to keep whatever you can from your budget in order to reasonably live (that's the whole point of being on a plan, isnt it, and Christmas is coming faster than we all care to think about)
You could also, when you feel ready, write to reclaim those charges (and any other previous charges during the last 6 years)
Recently I was sorely tempted to try and beg/borrow/steal to pay off a reasonably small (£145) debt when the company offered a lower full and final settlement offer - as much as I wanted that debt gone, I decided that it may as well join the queue with everyone else. I knew that, had I cleared this "just one", the next month there would be another, and then another etc and I would have been back at square one robbing Peter to pay Paul.
Of course, only you know what your situation is like and you can obviously choose a different course.

Very quiet around here lately!!!
Anyway coupla questions my learned friends
1) If you have a small debt on your dmp..say £250, and you can save the money up, can you ask cccs to specifically pay that one debt off?
2) Do cccs negotiate F&F figures with creditors in the future? And are F&F only available once the debt has transferred to a DCA?
