    Hi Marste,

    Please feel free to post any of your concerns on here regarding the forms and we'll certainly help you all we can with them. The CAB do a wonderful job but they are certainly overworked at the moment with the current financial perils.

    I found this site more than helpfull enough for filling in the paperwork etc and many many advisors like immorralangel come on this site to offer their free time and advice so ask away and we'll help all we can.

    Hope you get sorted with the paperwork m8.

    I have had loads of help from CAB. THe help and support I recieved from them throughout my debt problems was amazing. Yes I did have to wait for appointments because of the amount of people needing help but I find that better than the times I visited CAB on the walk in days and sat for hours waiting to speak to someone. Anyway hope you get sorted in the end : )

    Thats it, i am done, Blind-as-a-Bat has left the forum, for good this time, there is no way I can recover this account, as the password was random, and not recorded, and the email used no longer exits, nor can be recovered to recover the account, goodbye all …………. :(

    The debtor’s bank account(s) will be frozen when a bankruptcy order is made. Before petitioning for her/his own bankruptcy, it is important that the debtor withdraws enough money to manage essential needs and to deal with immediate emergencies, until s/he can open a new bank account after the order is made.

    Which forms to complete

    The debtor must fill in a Statement of Affairs (Debtor's Petition) (form 6.28) and a Debtor’s Bankruptcy Petition (form 6.27). The debtor should follow the official court guidance notes available at Her Majesty’s Court Service (HMSC) website at www.hmcourts-service.gov.uk.

    The debtor will need to provide detailed information about her/his income, expenditure, assets and liabilities.

They are also available on The Insolvency Service website at www.insolvency.gov.uk or on Her Majesty’s Court Service (HMCS) website at www.hmcourts-service.gov.uk.
    Making an application online

    Forms can be completed online on The Insolvency Service website at www.insolvencydirect.gov.uk. The debtor will need to register with the website and will be able to access the information on the form and edit it until it is finalised. The completed forms will need to be printed off for signing.

    A dedicated helpline on 0845 602 9848, open from 9am to 5pm, will answer questions about online petitions. Enquiries on online petitions can also be e-mailed to [EMAIL="onlineforms@insolvency.gsi.gov.uk"]onlineforms@insolvency.gsi.gov.uk[/EMAIL]. The Online Forms Service Frequently Asked Questions contains information covering commonly asked questions about this service.
    How many copies of the forms are needed

    If the debtor is using the county court, s/he must take to the court the completed debtor’s petition form and statement of affairs form, together with two copies of each and the bankruptcy fee and deposit.

    If the debtor is using the [URL="file:///E:/Program%20Files/england/13152450.HTM#which_court_to_go_to"]High Court in London[/URL], s/he must take the completed forms, together with the bankruptcy fee and deposit. S/he does not need to submit copies.

    The debtor must date and sign the forms. S/he should also make sure s/he retains a copy of each form for her/his personal records.

    The insolvency website is fab and you should be able to get advice on filling out the forms on there. :)

    Alot of the cab's funding from the council has been withdrawn and allocated to profit making law firms instead. I am a volunteer adviser at a small bureau and we try and see everyone depending on what staff we have in. We are always booked up for appointments months in advance and my role doesn't involve meeting clients, I also have to do admin with typing up the case history so if the client returns the next adviser has all the info to hand.

    That's so true. Clients don't see the whole picture and the amount of work that goes on behind the scenes. We're lucky in our main bureau that we have 2 debt caseworkers (3 once I'm fully trained.), and a benefit caseworker. But we have to cover a large area and have a number of outreaches as we cover quite a rural area.
    It's not an ideal situation, and like you say a lot of loca authorities are removing funding and setting up their own smaller (and therefore cheaper :rolleyes: ) advice centres. Sadly this means that a lot of people will end up not recieving the help and advice they need... :confused: Where's the logic?

    My local CAB is NED-CAB & although I`ve been in twice & left voicemail...I am now advised that the waiting time is around 12 weeks!!!.

    I can`t wait that long even though I need face to face advice I have no choice but to go back to CCCS...& they are busy too.

    The NED CAB website is excellent though!

    I understand how busy CAB is now...surely the authorities should recognise this!

    The main problems are lack of funding and lack of volunteers to meet demand. Especially since the training involved easily takes up to a year for new volunteers to become advisors, you can imagine that the people who stick it out are few and far between when they aren't getting paid for it! It's a real shame as there are so many people out there who need the help but we just physically aren't able to see everyone as fast and efficiently as we should be able to.
