I haven't got a date for the first hearing yet.

I have asked the solicitor to tell me as soon as he knows. In Spain though they usually sleep through August so it might not be for a while.

He has written to me though confirming that the figures have been corrected.

He didn't seem to have a problem with adding up when deciding what to charge us!

    How true Neverdespairgirl!

I have heard from someone else who is being asked to complete that they have been given an end of August completion date. Also that the developers have still not got the cedula which will allow them to force people to complete or loose the deposit. The developers apparently say it will be the ‘end of next week.’

The longer the better from my point of view as I think if it goes past the 11th August, they will be a whole 2 years overdue. It then enters into a different ball game according to the solicitor and we have a much better chance of getting some or all of the money back.

Obviously, the developers will be aware of that and will be trying to make sure they get the cedula in time, no matter who they have to bribe. And since generally, you can’t get any paperwork out of anybody in Spain in August, it would probably come to that.

I've just spent an hour going through this thread (heat outside is too much!) - what a rollercoaster ride!!

I started by shouting various things at the screen that others had also posted, but end up wishing you well and hope you get things sorted.....

Ah, fame at last. Pity about the fortune.

Thank you so much for your comments. It definitely brought a smile to my face having just spent far too long on the computer reading all about the Egypt issue, buying abroad. But it is interesting and if forums are the new chats over the garden wall, they are also a little bit net curtain twitching in some cases.

But i am immensly grateful to all as it is a big release to write and receive on the forum.

I will try and post tomorrow other tiny bits and pieces that I have got. Nothing huge, but yeah, just bits.
    Thanks all.

Hope no-one took offence at my curtain twitching comment. I know that you are all wanting to help and you can be assured your words of encouragement do help.

I’ve been a bit potty lately. Just like being on a complete nervous edge and my insides all shakey. I think that was has happened is that now the family have gone home and it is back down to just me and OH, all I do all day is worry about it. And that drives OH nuts which is not helping. Because I keep checking on forums to see if there is any news, it has sort of got a ridiculous pitch. And now I am looking at people’s problems with Egypt properties. Good grief! What am I doing????

Anyway, the developers in our case have got the cedula now apparently. The last date for signing they have given is the end of August.
There is quite a bit of unhappiness caused by the developers according to people who are living in apartments in the 3 complexes which were completed prior to this fourth one. Snagging still not done after 2 years etc. The message they give is also that community living is not great. So that is food for thought. Not that we are going to be living there anyway.
Also it appears that ‘our’ estate agents and their numerous awards were bought. I haven’t looked into exactly how that works, but apparently the EA’s are the laughing stock of other EA’s in Tenerife. We have given up on the idea of trying to take a class action against them despite the fact that we are appalled by their outright lies and at how they have spoken to us in emails and have pretty much been dropped now. Maybe I should have resisted making a comment re their mission statement which went along the lines of “‘Service and Security’ - indeed” Well, it pleased me at the time (and still does because it is so not true) but it made the director a tad bad tempered!

By the time I am 80, should I live that long, I should be very wise. Wish I could do the wise bit now and not bother with the getting old.

I still don’t know when the hearing is.

And I am going to stop worrying. And be especially nice to OH …..

maybe you could just accept that , just for now, for the next few weeks till the court case, you Are going to be a worry-bags - and just accept that - fighting against something that you are obsessed with - simply makes you more tired than you were before.

my mother used to clean like a demon when she was stressed, and i also find that helps me - but only Very occassionally do i let myself get that stressed these days, a good hoover at high speed reduces my anxiety levels

i also love to just walk out of the house, leaving the computer on, and go to a peaceful country spot i love and just sit and do sweet fanny adams for a while

Have been away for a while and reading your thread with great hope of some good news to read at the end. Sorry to hear you've been a worry bucket about it all,a lthough very understandable.
I hope you can try to put the worries into a box and send it out to space where it belongs. What will be will be, and the sun will still come up tomorrow and set tomorrow night if we're all lucky..
Easy for me to say, but keeping everything crossed for you.
When I was going through some tough times, someone I did'nt know very well told me they were praying for me and my kids, I'm not religious, but was still very touched people still care. I get the same feeling for you, keep your chin up chuck....

Just got an email from the EA saying we have one week to complete.

So .... the developers have not told them that we are going to court – and nor have I.

I will contact the solicitor tomorrow and ask him about this court case again.

Luckily, I haven’t had to resort to cleaning as a way to stop worrying which would be dire indeed and have been able to make sure the worry hasn’t taken front of house space in my brain lately.

Thanks all for your thoughts. I can't believe how kind you are.

The solicitor says that the hearing will not happen during August, so it looks like it will be September earliest before we hear anything.

I replied to the EA saying I have no idea why the developers have given me an extension and – honestly – what use is a week. I also said that they must urgently see what they can do to sell even if we incur a loss. I am not sure why I did that as my ownership of the contracts will be rather dubious. But it does say in the contract under the section about people getting 50% back that it is dependant on the developers finding someone to buy within 6 months.
I am just trying to cover all bases really. And I probably just said it to annoy the EA, cos they sure annoy the hell out of me.
