just an update today, well the postman has been, and surprise surprise, no letter from CSA
Phone CSA Sarah Carr, she says they are aware and working on my complaint and will call me back!! What is the point of having deadlines when the CSA do not adhere to them! Bloody raging
And to cap it all last week i received a letter out of the blue from them stating they are going to take legal action over me because they state i owe £4851.24!!0 -

Really there isn't one IIRC, as you can go through ICE or through the ombudsman. Not both.
If you aren't happy with the responce you get from the CSA tho I would advise ICE that the ICE have missed the deadlines and not held up to the recommendations etc.
You could also appeal the decisions as phasing is part of hte legislation so has to be correct. The appeal office may be able to look at the phased amounts and get them corrected without it getting to the hearing.
Just a brief summary of phasing tho(sure you have heard all this before) In a case where you have two children you will pay 10% each (20% total) but where the first case was assessed under CSCS (old rules) then the amount shall be phased up or down by £5pw (£10 if income over £400pw) and is capped to a max of 30% overall.
(Example: old amount is £100pw, new amount for two cases is £60pw (£30 per case) income is £300pw
New case will be paid £30pw whatever, old case will pay £60pw (30% max limit is £90pw) and in this case it is unlikely that pahsed amount will ever change until 5 years is up.
BTW phasing was quite possibly the worst bit of legislation that was written into CSA law, and was totally unnecessary. Old rules multi AU's never had the same protection and simply changed from the date of calc onwards to the new rate.
I hope that they don't try something similar for the 3rd scheme under CMEC.Nothing to see here :beer:0 -

Im happy with the ICE, its the CSA who have not responded by the deadline given to them
As with phasing, im classed as a middle income earner, worked it out in paying roughly around £5,00 over the 5 year phasing plan to my first ex (who is on benefits and working!! undeclared i think) I dont agree that if she is on benefits I should have to pay phasing, as her benefits wont change, so therefore she wont suffer any financial hardship, but ive just learned to get on with things, only another 2 years of it to go!0 -
another update folks, ICE have now escalated thisto their management team, they said they will contact me by the 25th February
I assume it looks bad for the CSA that they have missed deadlines set out by the ICE, not even an interim letter. Or does this happen all the time?

I've no experience of ICE, as you know, but I would be booking an appointment at my MP's next surgery to explain the situation.
I would be asking the MP to write a letter to the CSA asking why the CSA has not responded by the deadline and stating that the MP will be forwarding your case on to the Ombudsman if the CSA do not respond by the extended deadline of 25th.
Get the PO forms in your possession now.
If the CSA still do not respond by 25th, you will have more ammunion against the CSA which is good.
I suspect the threat of involving the PO won't spur the CSA into action, but the intervention of your MP might.
If the PO does get involved I appreciate it will take more time, but it works in your favour...more compo etc.
Having the MP on board may help you halt the legal action too.
Have you asked what ICE are going to do if they don't hear back from the CSA by 25th?0 -
they never said what woud happen if they didnt respond by 25th
as to the legal action, i called the CSA when i got the letter, i know that they have mucked up by sending it, but because im on a DEO just now i dont want them increasing it whenever it suits them, not that they can take anymore!!
the woman had the cheek to ask if i had been paying anything, i just laughed and said please dont go down that road!, she said she would get the guy who sent the letter out to call me within 48 hours, i stated just to get him to write explaining where the arrears came from etc
no word as yet from them!0 -
just an update on my case folks
CSA had until 6th February to answer the ICE's recomendations, never heard anything from them apart from a letter demanding arrears a week before they were due to answer the complaint!
Called the CSa, they stated that they were aware of my complaint and were working on it as they had been busy, told them that was unacceptable and they should have wrote an interim letter informing me of this! After this i contacted the ICE, they said they would escalate to senior management and get back to me on the 25th February
well guess what today is the 26th and still no word!
Getting sick of the whole thing, my next payment rises another £155 to £722 just because its a new phasing period!! CSA haven known about this rise as it happened last February as well and a face to face examiner told me its because the computer cannot handle a new phasing period so it calculates ridiculous figures!!
only thing the CSA havent robbed from me is my pride and i will not let them!!!!0
