another quickie :) if before we voluntary reposses one of the unsecured people decide to take us to court for a ccj would it likely to be issued on our current situation (ie £600 short per month) would the ccj be granted?

Having looked at the direct.gov.uk site a ccj will only be issued if something can be repaid towards the debt as this isn't the case with us and it went to court what would happen with the debt?

sent a load of soas to unsecured creditors last week, don't want to tip northern rock off just yet!

Received a friendly letter from MBNA (the ones that have global advantage hounding me!)

After trying to knock some money off my expenditure which they couldn't and with a defecit of nearly £600 they say the recommend a dmp! Sweet jesus so i told them they had no chance. After 10 minutes of holding they said they would note their computer but would continue to add interest and charges as well as refer it to a debt collector in 6 months even if i went bankrupt!! Bless the young man sounded abit shocked that I knew more then him and said they can't chase me.

Arh well least they were nice it and they know as well as i do they can't do anything. The best tool against them is knowledge :)

had quite a constructive day yesterday, spoke to MBNA who have been hounding me via Global Vantedge for the sum of £30, well will be more tomorrow as I've missed this months payment. After 30 minutes on the phone MBNA 'agree' to remove my telephone numbers from the database thing that they ring me from and just have it in the notes as well as contact via mail only (I sent them a letter telling them all about harrassment laws etc).

I also spoke to Northern Rock who considering we owe 100k to are so laid back its unreal, probably because they have to many cases at the moment. They just said don't worry about it and just to ring them when we've moved out to do voluntary repossession, no need to mess about with keys because they change the locks although I fail to see how they can get it in in the 1st place?? Also mentioned that once we'd signed the form (yer right) they will be in contact to discuss the best way forward in terms of the £45k negative equity and the best payment plan for us (bless).

Well today I received something totally unexpected, an apology letter from Virgin/MBNA!! They and GVI have been hounding like dogs which for the moment equates to £30!

I sent them the harrassment letter and called them, they took my number off the database to stop calls and received a letter today to say they will do a full investigation into the situation and will let me know their findings by the latest 15th August. Probably a load of rubbish but cheered me up :D

I wondered about this too and offered to post back the keys. They told me (very nicely, like you I was quite stunned at how casual they were about the whole thing!) not to bother because a locksmith will be sent and will very discreetly change the locks (I was worried about them kicking the door down or something :o was thinking of the poor neighbours really). Also mentioned that once we'd signed the form (yer right) they will be in contact to discuss the best way forward in terms of the £45k negative equity and the best payment plan for us (bless).

You sound much more positive than you did at the beginning of this thread :D Well done, you're doing great :)

I do feel more positive for actually speaking to everyone, I think knowledge about where you stand and what they can do is a powerful tool that cc and loan call centre workers can't cope with :rotfl:

I've also just found out that I'm having a little girl so am over the moon and my little boy is happy he doesn't have to share his trains too!
