    All i can say is that if you where wanting to buy time then that advise would be fine But unless as Rich said something happens to increase your income drastically it will be a pointless exercise so the only question is can you see that happening in a reasonable time frame, if not then its back to plan B

    If what CCCS have told you is to offer all your creditors £1 pcm including your mortgage and your O.H's CCJ's then I think they're suggesting the same approach as me. You've only got limited income, and it's got to be prioritised accordingly. You'll need the cash for bankruptcy fees if that's the way you decide to go, and you've got to get that money from somewhere. Don't miss Council tax and utility payments but anything else you might as well ignore.

    Unsecured creditors are not really a problem and there's no Court in the country that's going to let your house be repossessed by a bank or building society when you've got less than six months arrears, nor will any creditor holding a charging order get much sympathy in Court.

    You need to keep your nerve, open that bank account in your own name, and then petition for your bankruptcy. If your O.H won't work with you, then do it yourself; and set him an example to follow.

    Hopefully debt doctor will show up in the near future, and I'd be amazed if his analysis was much different to mine.

    Surely WAL could book an appointment for couple of weeks time and go Bk without all this bother?

    There are twenty odd creditors, most of which are OH's and it seems unfair to put her through all that work just for a few weeks.

    I recall CT going BK within days of her apointment with Christian against Poverty.

    Not getting at you RS, just at the bureauocracy of it all. Oh can't spell and can't be bothered at this time. I am off.

    And if OH goes BK, he will not get his mitts on another CC, so that will sort things.

    I agree whole heartedly, but it's never that simple when you're the one caught in the middle of something like this.

    Wot a life and her O.H have got children; they've obviously worked hard as a couple to buy a place that means a lot to them; he's got health problems associated with his work, and you'd struggle really to put any more pressure on a couple's relationship.


    All I'm trying to do is outline a plan that worked for us; one that I've seen work for others, and then hope that Wot a life can adapt it to suit her circumstances.

    I'm going to get in touch with National Debtline for a 2nd opinion I think, if the advice is the same, then I will have to go with it won't I?

    Yes OH was self employed and still is, which means he's not entitled to incapacity benefit because he's behind with his stamps due to being ill with suspected emphesemia for almost 5 months last year. Which in turn meant, he doesn't get any sick pay or government help if he doesn't work.

    Yes Richard, the £1 a month does include OH's ccj's, I am to offer this on a form from the courts N254 and make them my priority (or his)
  • Are you sure this was CCCS's long term advice - normally you speak to the Helpline who will give you some general advice and then book an appointment for a full 1 hour counselling appointment to offer you full advice. They do sometimes offer to send a self help pack so maybe that is what's happened with you. If they haven't booked a counselling appointment then I would suggest you call them back and arrange this

    The first time we said hello, was the first time we said goodbye. As the angels took your tiny hand and flew you to the sky-you forever left us breathless. RIP my beautiful granddaughter :(

    That did cross my mind last night but as its so long since mine i thought they might have changed things a bit....maybe not by the sounds of it.

    Do i remember someone posting that the CCCS had a dedicated BR section who you can ask to speak to if you thinking of BR, if so that may be a better idea

    There is a CCCS bankruptcy support team but they only deal with people who are already CCCS clients so WAL would still need to go through the counselling appointment first to confirm that bankruptcy is the best option

    My uncle gave me that nickname when I was just a nipper. Unfortunately, he died very unexpectedly just after midnight on Millenium Day so it's my little way of remembering him
