    Hi All,

    Having a really bad day today......

    Had a letter off the mortgage company about the arrears we owe, they now stand at £3,094.45, the total outstanding on the mortgage is now £170,010.25
    They are advising me to contact them as a matter of urgency, If I contact them, what do I say??

    I've also had a claim form sent against me from Northampton County court, one of the creditors wants to place a CCJ on me for £779.00

    Anyone?

    Northampton County court run a fastrack system to get the ball rolling and some creditors seem to be useing it as a battering ram to try to force you to pay.

    A CCJ isnt as bad as it sounds as you have the chance to present your case and a judge will only award them a payment you can afford so they are wasting there time at the moment

    I never got that far as a CCJ......i bet them too it:p but im sure someone with better knowledge will be along soon

    And i know Rich will pick up your question re the house

    Just dont panic as nothing is going to happen overnight;)

    I got a CCJ but it was a couple of months before BR so never bothered contesting it.
    Northampton (I think) is like a central processing court and if you plan to contest it you can have it moved to your local court.

    Someone with all the technical gumph will be able to help better !!

    If you defend the CCJ, which you should do, it will be transferred to your local court. If you are not going BK, that is when you argue for monthly payments. If you are going BK then it delays the hearing until you have had time to do the deed.

    I've filled out the defence form, but not to appeal against it because I know I owe the money, I'm just a bit stuck on how much to offer them on a monthly basis because I have no surplus income?!

    I don't want to offer them what I can't afford to pay, I can't afford anything at the moment!

    I don't know what to do?

    I've just had a phone call off the cccs and have an appointment for next tuesday afternoon, should I wait until I've spoken to them before I send it off?

    And what about the mortgage company? Should I ring them and tell them what? or wait until after my phone interview aswell?

    Can you afford to offer them a £1.00?

    If you can't, is there anything your O.H can use his card to pay for that you would've normally paid for? Using a credit card for essential expenditure in a situation like yours is very common, and won't get you into any trouble.

    As for the letter about the house, I wouldn't bother ringing them at this point. Wait until you've spoken to CCCS; there's no panic. Our mortgage arrears were £9k and we still got to keep our house.

    I can understand why you feel confused, and I realise it's so much easier for me than it is you, but I have been in the same situation as you, so I know how you feel, and I know your problems can be solved.

    When you get to speak to someone from the CCCS, and they say pretty much the same as me, you'll feel a huge sense of relief that you can at last see a way out of your problems.

    Keep believing, and keep posting, even if it's only for a moan or a whinge.

    No, OH won't use his card for essential living, that is HIS card for HIS spending, and when he doesn't pay the statement, he'll chuck it at me.

    I'm so scared I feel sick, I come home to this everyday and my head is a total mush.

    I'll try to put it all to one side until after the interview next week, but it's so hard.

    He's not being very cooperative is he? Never mind, I'm sure you'll manage without his assisstance. Is he not making any contribution to the household expenses at all?

    The letter from the mortgage company can wait, and to be honest, if you do go the bankruptcy route, then the CCJ doesn't really matter either.

    I'm still making the assumption that keeping your house is your main priority.

    I'll be off-line for a while but if there's anything I can help with then please post again because I'll be back on later.

    I could ask about HIS family and HIS responsibilities but at the mo, I guess he would not be able to hear that?

    Wot a life. When we are scared and the fight or flight mechanism kicks in, the adrenaline reduces the blood flow to the digestive system. Which is great when we need the blood to respond to danger but in your situation you cannot flee or fight, so the situation is not resolved and your body responds by feeling sick.

    It may also partially explain the mush, although you have so much to deal with that it could just be overwhelmed.

    Try just acknowledging that the situation is scary and it is reasonable to be scared but it will not be going on much longer. You may find that the sick feeling reduces.

    You are an amazing lady and how you have coped so well for so long, I do not know. And I do not even know half of it. Big hugs.
