Congratulations on the application being refused! Sometimes we have to stand up and say NO. I've had to object to planning applications on four occasions and, luckily for me, they were turned down. What got me mad was that the plans were so obviously wrong for the area, the applicant must have been nuts to even think they'd be allowed to do it! At one house it was to convert a building at the back of my house into a theatre for an amateur dramatics group!!???!
No offense to you amateur dramatics peoplesit was just a ridiculous site!

You'd be surprised in our case, the traffic survey has already concluded that despite this being a residential area with a couple of small scale and long established businesses, but mainly of terraced houses and narrow streets, that the application will not cause undue traffic or parking problems

Update to my earlier comment, the new application for the "reserved matters" has now been submitted and letters sent out to residents, with the consultation period lasting until 22/8/2008

I need your help again! We are now on application number 3... there have been two applications with the reserved matters declined. The main sticking points were
1) Highways weren't happy with the visibility from the driveway, and that they would comply with parking recommendations (turning table would be installed)
2) Ours and neighbouring bungalows would be overlooked from the first floor windows, and due to the small plot would be overbearing to us also.
A good thing (we thought) in our favour is that our bungalow and the new property would only be approx 12m apart, and the recommendation is for 25m for facing properties.
However, outline permission was granted in 2006 without any reserved matters, and our objections dismissed. My local councillors agree that outline should never have been granted, and this was due to a lazy p.o.
The original application had the master bedroom, ensuite, stair and bedroom 2 window overlooking.... this latest application has seen the bedroom 2 swapped for the main bathroom.... the application before had the master bedroom window removed altogether (it has a window to the front)... so now there are no habitable windows remaining on the first floor. And they have reduced the width of the property from 12m to 10.4m.
The councillor that I have most interaction with regarding this has emails from the planning officer stating
The new application has reduced the width of the proposed house from 12m to 10.4m and the overlooking to the rear has been removed by placing the en-suite and bathroom (both obscure glazed and this can be secured by condition) and the landing windows on the rear elevation. A landing is not a habitable room so we would not be able to justify refusing planning permission on the very limited overlooking from this window.
The site already has outline planning permission for one dwelling so it has been accepted that the site can accommodate a dwelling even though it is not possible to have 25m separation to the neighbour.
I haven’t yet received Highways comments on the changes to the access.
Subject to Highways comments, in my opinion this is now an acceptable proposal. If you object to the proposal and wish it to go to Chairman’s referrals in the New Year please confirm this in writing/via email with any objections in addition to those detailed below.
So.... it looks like this one is going to go through after all :undecided. The original outline application was made in May 2006..... does this expire at all? Would it be a case of they have to just apply to extend this time frame, or do they have to succesfully gain full permission within a timeframe?
If anybody can provide me with any ammunition for my latest objection letter I would extremely grateful. OH is ready to throw the towel in and admit defeat right now (after seeing the POs comments above), but I'd like to give it one last try.
My main point all along was "single dwelling" doesn't have to mean a house, it can mean a bungalow too, which wouldn't encroach on us as much obviously.....

I think they have to apply for the full planning permission within five years, which they have done.
I haven't worked in planning for nearly five years however, so I may be a little rusty and legislation may have changed.(AKA HRH_MUngo)

If it was 2006 I think it would be within 3 years before their outline expires, although I would look at the original application. If the applications for reserved matters keep being refused, then they can not commence development, so the original permission will expire anyway. I will try to have a more thorough look in the next few days, but I need to sleep now as have an early flight tomorrow.Debt January 1st 2018 £96,999.81Met NIM 23/06/2008

The "public access" to planning is a recent addition to the councils website, and I've just re-visited and noticed that the original application was scanned in in November... I'm sure I just read that it's three years.... so, it's interesting that they need to be granted full permission within those 3 years.... if we can just stall them for a bit longer.....

Hi ClassicMad, apologies for the delay in replying, I am out of the country at the moment. So first off I'm very sorry if I ask a question that has been previously answered, but I don't have the time at the moment to go back looking, however I will check in again over the weekend.
Anyway, in answer to the first issue their outline permission expires on 02/06/2009, so if they have not got the reserved matters approved by this date then there will be no underlying consent on the land. An expired permission is not really worth much as planning policy can change significantly in that time, and it may no longer comply to current guidelines. From the sound of what you've said the councillors regret granting permission in the first place. How is the application being decided this time? If you can get a councillor to object to the application and request it goes to comittee this may be best for you, as you have the oppertunity to speak, and committee is often very sentimental and tend to go with the residents rather than developers.
