    Once you go BR then the debt will fall into that. Meanwhile as long as the baliffs have never been in your house then they have no automatic right of entry.Just keep your doos and windows locked and if you have a car out front park it away from the house.

    Thanks for the response unfortunately the baliff came in and agreed the monthly payment plan. That was the old house what rights do they have if they traced us?

    We haven't registered with the local council yet just been too busy etc etc

    We can't pay the fees for the br until end of the month? We were just going to do as you say and keep everything locked and the car away from the house!!

    To be perfectly honest I have idea if they will have right of entry at your new property, I am assuming they do. But as it is only a couple of weeks to go before BR then I suspect you will be ok. As you said just keep your head down and the car away from the door.

    If you are at all worried try sending Herbie21 a PM. She is an expert on baliffes and will be able to advise on the whys and wherefores.

    This is what the mortgage company have asked us to sign it looks different to examples I've seen before pls could you take a look

    i/we confirm that i/we have abandoned the above property/agree to give you voluntary possession of the property. I/We surrender vacant possession to Mortgage Express as Mortgagee in possession, to negotiate a sale. I/We understand that by abandoning/voluntary surrending this property, it will not release me/us from my/our financial obligations under the mortgage. i/we also understand my/our details will be enterered on the Council of Mortgage Lenders repossession list.

    What do you think is it okay to sign?:confused:

    No don't sign it. I know very little about houses but i don't like the bit about still being responsible for the financial obligations of the mortgage. Hold fire until one of the house experts gets out of bed:D .D

  • Don't sign it would be my advice :)

    Send them a letter telling them you wish to voluntarily surrender the property and that it is now empty. But be warned - they may well ignore this :rolleyes: Northern Rock did for us.

    To be honest though, it doesn't really matter whether you give the house up voluntarily or let them reposess. So, I really wouldn't stress too much about it if I were you :)

    Who is your mortgage company?

    eta. I have the letter I sent to NR here on my laptop, I can post it if you like to give you an idea of how to word yours.

  • Dear All

    It's been over a month since I've posted a message on the forum. Time has flown by, the rental house has become home and we have become hardened to threatening letters. We have finally got round to filling in the forms and plan to go BR at the end of the month. Health is not great for either of us but we still have our jobs and the family are happy so we keep remaining positive. My problem is I over analyze everything and cannot stop thinking things over all day it's draining especially as the thoughts are usually negative. My jaw clenching is taking over!!

    Please could someone take a look at our income and expenditure and check it's okay.
