Yes I doA person can get a million R&Rs, they can go around the store for hours searching them out and they would have never broken the LAW .
Never said otherwise, and think they should not be allowed to ban anyone who avails themselves of this policy, however neither would I say they would be breaking the law if they decided to "double check" the prices at PoS , to ensure only the lowest price was chargedTesco's in every instance when it has sold a product above the lowest advertised price has broken the law. .(EDIT or refused to sell at the lowest advertised).
Questionable statement - The Consumer Protection Act says that it's illegal to sell things for the higher price, but if the shop has made a genuine mistake....it is very unlikely that it would be charged with an offence.( nicked from Welsh Consumer Council) I would say it would be more even questionable when the lowest price was not the most clearly displayed
and of course (re your edit ) refusing to sell is not breaking the lawIt is a deliberate attempt to mislead customers on the basis of because they have 50 products they'll never know .

They were asked to sell the product at the SEL label price per KG and refused, thus that answer is clear. Incidentally the product is in other stores at the lower price, see misprice thread for evidence
Neglience is within the realms of the law of tort, and is a remedy for loss of damaged caused as when a duty of care has been breached. For instance, when a product is defective and unsatisfactory steps have been taken to avoid the product being defective. Thus has no influence on this subject matter.Drat and Double Drat, curse that Mr T excuse for not giving me a refund. :rolleyes:

Accepted in that case , but your statement that I referred to was about a misprice in a trolley load of goods, when an unsuspecting shopper was being overcharged.

I wonder if back in the days when T's stores were not open 24hrs and they could close over night to do there re-pricing, if they had the same mis-pricing problems as they do today.
The other day i went to my local T's i bought a cd it was the bassment jaxx one ive wanted to get it for ages, it was mis-priced and i did get a r & r, whilst i was there i pointed out to the cs other pricing errors in the store, now i couldve bought these items then taken them to the cs and got a r & r, i didnt do this i told them about the fish, cheese, gammon joints and the pork loins, i have just been into the store to get my lunch and i was astonished to find all the products are still mis-priced.
So after me telling the cs and giving them two days to sort it out there still wrong, they have untill 6.00pm to get it right, i am going to buy one of all the products just to prove a point.
I will let you all know how i get on.0 -
hi guys im a new user and desperatly want to get in to the mr T's thing but dont know where to fid the price lists. I live in a small town and there are four Mr T's here well worth a hit dont you think.. Please help

It has always been difficult to prove the "mens rea" required to prosecute for deliberate overcharging, which is why it is usual to prosecute for reckless overcharging. It is then necessary to show that the company did not exercise "reasonable precautions" or "due diligence." This comes down to systems, training, and doing the job properly.
I have posted before about the systems at Mr T's and how they are probably unworkable. It also depends on the resolve and resources of TS Depts, who are often overawed at the prospect of taking on Mr T. Many shy away due to potential costs, and the fact that Mr T will have much better lawyers than the council.
The refusal to sell items at the indicated price is more tricky. Any shop can refuse to sell an item, thus preventing the supply of overcharged goods. It is possible to prosecute for "offering to supply" but in reality a TS Dept will rarely prosecute without an actual supply. They will do test purchases to get the best evidence if possible. That way it can be established what the actual price is, compared to the price indicated.0 -

I rest my case, it is obvious that they are deliberately overcharging when this happens, they have failed to take action and are in clear breach from this point in time when this occurs. The evidence of this type of action is overwhelming, frequent and inexusable, which can be read throughout this thread and those prior to it.
Do all the stores in the UK make the same error without noticing it for several days via the famous 4 point checks ??? ie the parmesan cheese firstly wrong at 17.49 vs 17.08 now wrong 13.08 vs 17.08 (£4kg wrong) virtually everywhere in the UK by the looks of it.
Human error in every store ???, one of two things are occuring they either have NO CHECKS (inexcusable as a defence), or they do and CHOOSE TO IGNORE THE RESULTS (even worse than previous), or a combination of both.
This is a multi-billion pound company not the local owner/worker in the corner shop, and the LAW will expect a degree of dilegence in pricing integrity of a far higher standard, as reflected by the resources at there disposal.Drat and Double Drat, curse that Mr T excuse for not giving me a refund. :rolleyes:
