Incapcity Benefit stopped after Medical !!

Off with depression only scored 4 points after their ridiculously manipulated medical :mad::mad: - none of the questions asked were answered honestly by the so called "medical expert" manipulating and twisting my answers - neither did they take my pulse/blood pressure?! What kind of medical is that?

Anyway I'm told my benefit will be stopped from 16.05.08 my next payment was due on the 24th....will I get paid up until the 16th? Or will they stop that payment altogether? What about my housing/council tax benefit? Will that stop as well? And will I be paid up until the 16th?

I have rent to be paid by the 23rd :(

Apparently you can go onto income support instead...do you have to fill out all the forms etc or can you transfer over with no gap?

This has sent my anxiety/depression through the roof....it's obviously tailored to get people who duffer from depression off benefits?

No wonder suicide rates are so high....these people do not understand depression/social phobia/anxiety

    You will get paid up to the 16th. They'll also notify HB/CTB so you need to inform them of a change of circumstances first. And you'll need to fill in a claim for IS.

    The thing is, many people who are suffering from depression would benefit from being in work. Being sat at home does you no good whatsoever - I speak from experience.

    I'm sure you will need to make a claim but it should be seamless and you can get help with gaps between payment

    think I would be off to CAB Monday morning where you will find both practical advice/help and support

    I agree but I'm undergoing a course of CBT not just sitting at home - also the psychical elements to my condition are over-powering e.g. throwing up every morning and not being able to eat all day....they didn't take this into account...the !!!!ers ....do these medical "experts" work on commission? The disappointed look on her face when i told her no to her asking if i go out drinking every night ..!!!!! she better hope i don't bump into her....

    Thanks for the info regarding my benefit ..my rent is £400pcm but only get £163 (housing benefit) every 2 weeks because i'm on 'high rate' incapacity...(£102 per week) how much is income support? Am I right it's only £60? If so will my HB be 'upped' to bridge the gap?

    I think, if you can claim income support, you will receivce full HB - well up to the value they term a fair rent for you anyway?

    Definitely speak with someone at the CAB.

    Can you appeal an IB decision?

    Yes...can appeal but searching some of the posts on here it seems like the process takes up to and beyond 6 months. :confused:

    Refuse to go onto JSA as I don't see myself capable of work yet...they can stick their new deal up their !!!! as far as i'm concerned

    hopefully won't lose to much due to difference being made up in rent..

    Ouch! I would definitely get the process in motion asap though, were it me. I assume they will backdate the payments if you win the appeal, but then that doesn't help a lot in the meantime.

    The medical experts assess whether an individual is able to work - its as simple as that....there is no need to take a blood pressure or pulse etc as its irrelevant to whether someone can work!

    I suspect the assessments are about to get much harder as theres lots of "depressed" or "stressed" people signed off work by their doctors who could easily be working. I agree with the above post that in most (and i say most) people, working would be good for their mood/depression. 20 years ago very few people couldnt work due to depression or stress - its just an easy excuse for some people not to work. Please note that i am not referring the OP to this as there are genuine cases of depression out there which, in my opinion, can benefit for a short period off work for recuperation post a bereavement or traumatic episode.

    Hopefully with the CBT, you are able to return to work asap. Is it too nosey to ask what may have sparked off your anxiety/depression- was it work related or something else?

    Do posts like this really help the OP, or anybody currently suffering with depression or other mental health conditions?

    Please remember that this board is about helping people get their entitlement, not giving personal opinions on whether certain conditions make a person capable for work or not.

    I had hoped the above post explained why a blood pressure/pulse was not needed. Also that it is a simple assessment of ability to work. Finally i did state that there were genuine cases for being off work of which the OP may be one!

    I did ask the op if it was possibly work related in which case he/she can seek help and advice from the Occupational Health people to support or appeal his case.

    In addition, I am not making a decision about the OP's ability to work or not to work. That has been done already by the medical expert - however, their decision does not seem to have been accepted.
