No, if the court decides you are stupid the judge will still decide the case on the facts and, based on what you have told us here which is repeated in the defence papers, you do not have a case against ICE, so will lose. The best outcome in that case is the judge will not allow the defendent to claim costs of you. But based on what you have said on here and your choice to ignore that advice, they will make an order for you to pay the defendent's costs.

Please can you let us know the time & date of the hearing so we can see the judge's findings afterwards?

Or they may decide you are wasting court time and ask you to pay the costs :)

Based on your original thread, I think there's a real risk of you losing your case. If you go ahead with the case having been advised that you will lose, the court may decide you are deliberately wasting their time or that its a fallacious case and therefore may find you liable for ICE's reasonable costs for defending themselves. I.E you may have to pay their legal costs which could be hundreds of pounds (I doubt the judge would allow them to have a barrister or QC to defend them which would be tens of thousands of pounds).

This is small claims court material, not huge legal fees, only travel expenses etc.

Its ultimately your call, but if you're clever enough to fill out a small claims court form and represent yourself, I doubt a judge would believe that you are too dim to understand T&Cs that you signed - even if you didn't read them as you admitted in the original thread.

The fact that the plaintiffs are citing his posts to the other thread is a bit of a worry for OP as he's admitted that he didn't bother read the T&Cs.

Not at all it is totally irrelevant to the case whether or not i read the t&c's and i doubt very much whether the judge will allow any citing from the thread as any form of evidence in a case,.
I am far from an expert just an ordinary joe very pee'd off at being treated like a mug but you cannot live life nowadays without picking up a few things about the law, saying that it amazes me how some people on here comment on legalalities with not even the basic knowledge of the rights we all have

This thread is soooo not helping the OP at all - do you not realise that the last thread dropped you in it? And you are creating a new one to drop you in it further?

  • I am sure that a 30 minute interview with proper professional advice would had alleviated the need to go it ‘alone’.

But alas, I assume most people do not like being told what is what and keep going until someone manages to give them the answer they want.

I shall watch this post with abandonment!

you are so right if these people had taken some proper legal advice there would be no need for this at all
but if they won't layout the money to exchange a faulty unit for one of their customers, i suppose its too much to ask to get them to see a solicitor which i have advised on a couple of occasion's
As for the original thread dropping me in you can see that i have answered all arguments, so think you are very mistaken.
There is not one thing i have said that will drop me in it.nor help them so it will be they who are wasting the courts time.

Did you follow court procedure and send the car radio people a letter before action?
