    The only thing I'm not sure about is what warranty comes with the player. The site implies 30-days but it's not explicit. You of course have your rights under the sale of goods act, so you can argue that the warranty is irrelevant. I've not heard any reports of Zunes being unreliable.

    I know what you mean fifer. I've had an email back about the brown one and its brand new apparently; bought for his teenage son who didn't like it because it wasn't an ipod and been sitting there for 6 months. More fool him; his loss is my gain IMO!

    lol fifer, I know. Well I would fall into the category of teenager, but at the same time hate apple for various reasons and despise labelling fads. Anyway, I bought the brown zune in the end and it came this morning. I'm just getting it set up now. However, I'm a bit disappointed tbh. The instruction manual's missing, the headphones aren't the zune ones, and they've obviously been used before (with ear residue on them, nice!), and the zune screen and direction pad is a bit scratched. Not serious scratches, but not the kind you would expect on a brand new item. I've emailed the seller, we'll see what she says. In the meantime, anyone any ideas what I should do? On another note, now I have a real zune in my hand I love it, I think I will get on with it. Thanks again guys.

    Seems a bit off selling something as new which isn't. However, it was a good price and a new one would probably pick up a few scratches fairly quickly. Do you think it looks used, or has someone maybe just tried it out and decided they don't like it?

    I've had an email back from the seller. She apologised profusely and said she didn't know that her son had even opened it. She's going to find out where the missing things got to. So I think it was an honest mistake, just a bit irritating that it's scratched.

    Why not wipe the mp3 and just add some new stuff. I take it you have it all on backup anyway?

    That's free and on the player you like. Buy some new 'phones.

    The issue isn't really that stuff is on the player, its the point that it was advertised as new when it wasn't. I have just spent £90 on the thing, I don't really want to spend more money on earphones. I do have some decent earphones anyway, but I just wanted it all to be complete.

    I'm getting more irritated by the scratches now. There's one in particular that is noticeable when playing videos. What do people think I should do? Should I ask for a partial refund?

    Absolutely.

    It was advertised as new and unused, not incomplete and scratched.

    She didn't think to check before posting? Nah, I think she knew fine and plain lied about it.
