Lloyds have instructed solicitors

Hi
They can withdraw money from another LloydsTSB account, so may be an idea to get your money paid into another account, especially as it is for the mortgage!
Maybe if you expand the letter to include your regular income, and then explain the situation with your husband, they will accept it without a complete income statement.
The first advice I was given, was to open up a bank account with a bank I had no connections with.
There is so much to think of, isn't there?0 -
Oh god yeah, my head hurts!i will call my wages department asking them how long does it take to arrange payment into another bank, i dont know when their cut off date is, plus we will ring our mortgage provider to send a mandate to have it paid out of same bank as salary, sheesh, got to laugh though, i copied and pasted that letter you provided and put in personal details went to print and NO INK!! i have saved it for now and when picking eldest up from school will nip in for ink! do you think someones trying to tell me something?:rolleyes:DFW NERD....560

Dear Sir/MadamRe Account No/Reference No:- 4563210025897412Mr A N Other
Since making that above agreement with you, our circumstances have changed.
We cannot now afford to agreed monthly payments because ... [your paragraph added here]
We enclose a Personal Budget sheet which shows our total income from all sources, and our outgoings. As
you can see we have only £123 per month left for our creditors.
The offers we have made to our creditors have worked out on a pro-rata basis, and we have written to all our
creditors asking them to accept reduced payments.
In view of our circumstances, please would you agree to accept a reduced offer of £27 per month. If interest or
other charges are being added to the account we would be grateful if you would freeze these so that all
payments made will reduce what I owe you.
Should our circumstances improve we will contact you again.
We would be grateful if you would send a paying-in book to make it easier to pay you.
Thank you for your assistance. We look forward to hearing from you as soon as possible.
Yours faithfully

R1 7HGDear Sir/MadamAcc/Ref No 4563210025897412Thank you for your letter of 01-01-2002. We are very disappointed that we seem unable to reach a satisfactory compromise in this case. As we have already explained, we can only afford £71 per month at the present time. This is the only realistic payment proposal bearing in mind the enclosed personal budget sheet. You have stated in correspondence your intention to commence proceedings in the county court against us. The commencement of legal proceedings under such circumstances could be counter to the Overriding Objectives. of the new Civil Procedure Rules. You will be aware that the Overriding Objectives underpin everything the court does. Moreover, paragraph 4 of the Protocols Practice Direction states that in cases not covered by an approved pre-action protocol, the court will expect the parties to act reasonably in trying to avoid the necessity for the start of proceedings. We would suggest that your refusal to accept our offer could be viewed as unreasonable and we would ask the court to consider this matter with reference to the Overriding Objectives. The offer of £71 is of course still open to you to accept.Yours faithfully
Mr A N Other

The reason DCA like you to ring is that they know people crumble under pressue on the phone and they are bullies, what you are doing is right and proper and it may take some time for them to agree in the meantime send the above letter, edit where necessary, enclose another budget sheet and make sure every month you send the payment you offered.0

Thank you rayday2, and thanks for fast response. i will indeed send that letter (to the dca or itchy and scratchy or collections at lloyds?) i forgot whos who with these as they seem to pass our account around? I have seen a template on forum for them to put everything in writing and to stop harassing by telephone? should i write one of them too?I tend to switch phone to silent now but with two children who might need to ring me when they are out thats not practicalDFW NERD....560
