Lloyds have instructed solicitors

Hi, last six or so months finances have been really tight with hubbys business not bringing much in and after paying mortgage and utilities etc have not had much to throw at cc. balance £10,831:23, (credit limit £10,000). Even after trying to ring in the early days saying we having trouble meeting the min payments and could we pay less for a while, they have totally ignored us and have rang constantly up to 6 times a day!! I have sent off two letters in the last month asking for some leeway and although we havent met themin payments have made token payments. we have tried to transfer to 0% on other cards and also applied for a loan to clear it but credit rating is poor so have been unable. Have recieved a solicitors letter demanding full balance to be paid within 7 days of receipt of letter (so next tues) or legal proceedings to commence. At the bottom it says "If you are unable to pay full balance. our Client may be prepared to accept a reducedsum, together with realisitc proposals for regular monthly payments. You must telephone our Client on receipt of this letter on **** should you wish to discuss such an arrangement." We prefer not to ring after last time as we feel we will be bullied into agreeing to a sum per monthly that we would not be able to keep up, I have seen template letter on National Debt site, do you think this is what we should do? We have always had debt but have always managed to avoid defaults and court so we are really feeling scared,

    also like to say, mortgage balance 31,000, house valued approx 120,000, so equity there but will have trouble getting remortgage cos of self cert (no books as yet from business) plus !!!!! credit profile!! feel as if every which way we turn to try and solve things, door slammed in face!!

    Who are the solicitors - Sechiari, Clark & Mitchell? If so they are based in Lloyds-TSB collections centre and are very poor at acknowledging or replying to post. I had to fax them copies of letters they had received and signed for by registered post but had not actioned!!
    I'm doing a self-managed dmp and use the National Debtline for advice and letters etc and have an arrangement with Lloyds-TSB for my credit card debt - all done by post.

    Thank you Leixlip 1, Yes they are the solicitors and I did notice that the address was Brighton so did think it was internally sent. As I said even after speaking to people in collections, they are very hard nosed and we just feel we will agree to anything rather than going any further!! I will use the templates and will send letters by registered post plus keep copies. Have just come off nights but feel absolutely sickened by this, so will be unble to sleep. Our fault I know re: debt but circumstances were a LOT different a year or so ago. Hubby had no choice to go out on his own as firm he was employed with went insolvent, he was with them many years and Lloyds were happy to throw products at us then!! Thank you again for replying

    Use the template letters on National Debtline website also they have a budget sheet that will list outgoings etc you can use. I used these and dealt with Lloyds and there pretend solicitors who write on grey paper! SHortly after they accepted the payments.

    Thank you Rayday2. I will fill in a budget sheet then and send it with a letter. btw yea the grey letter it was lol, hopefully they will accept, it will give us some breathing space until we sort out this mess. thank you very much:beer:

    Omg just read on another thread bout someone having a charging order on their home because of an UNSECURED loan default of 11,000!!! Im totally freaked out NOW!

    only received letter this morning (see above) just had voice message on phone from woman called "sarah" calling from Moorhouse agency?? acting on behalf of Lloydstsb, gave a number to call her. Havent had a chance to, reply to letter yet!! stressing us big time!! I was going to go on national debtline for the template letters but just feel like giving up now!! They are not going to leave us alone

  • We had letters from their solicitors too, and our loan was sold to a DCA, for more than your debt. They always threatened legal action it's away to get more money out of you, and even if it did go to court,It's not scarey at all.

    But we only had the letter this morning asking for fully payment, would it have been sold already? Are they a DCA then? I dont know who to send the template letters to now though? the ones asking for a reduction in payment and I/E sheets, Think it might be too late to try anything now
