Personally I would still refund just to try and get some goodwill to get your final value fees back. If you let this go to the wire you will be no better off.
Regarding fees, ebay allow you to reclaim your final value fees only but if you try to do this through a full NPB the buyer can appeal as he did pay and you will lose. If you go for a mutual the buyer has to confirm , and if you refuse to refund until you are forced to I can't see him agreeing to this. If you do get an agreement to do a FVF then you will just get your FVFs back, not the original listing fees or upgrade.
To reclaim your losses you need to apply to the RM and it can take months, but again in some cases, as per my previous post, this will also require the buyers agreement, another reason not to agravate him any more. One other thing, I think I saw on an earlier post that you had taken out additional insurance with the Royal mail? What are my FVF's likely to be on this? And what's an NPB?
Paid the extra £1 for insurance up to £100 so will hopefully be OK there. Just wish we'd done recorded but lesson learned!
Honestly he's being such a d*ck I don't want to do him any favours but I see your point about the Royal Mail claim. If they call him and he says he did receive the parcel where do I stand with his paypal claim then? Money will have been refunded but he's now saying he did receive.0 -
The RM and the Paypal claim do not interact. If you can't prove delivery online then you can't win a paypal chargeback, even if buyer confirms in email or whatever that he has th eitem you will still lose a claim.
As for the RM side of things, the buyer doesn't even have to say he hasn't got the answer, if he is randomnly selected to be contacted and doesn't reply you still lose your Royal Mail claim. Also you can check your FVFs in your account on ebay, but they could be as high as £4.

You can't open an unpaid item dispute as he did pay.
You could try ringing jobsworth again at the sorting office but rather then being you being the buyer?? You have all the details they would need ie name,address,postcode - little dishonest but just a thought - would be quite nice to mail him back and say "actually,it's at your sorting office!!"0 -
The sorting office should help the sender though as long as their name is on the parcel, as it still 'belongs' to them until it is delivered. Obviously the RM won't hand the parcel back to the sender, but they should be able to say whether or not they have it.

It took me a few attempts, but when I misaddressed an item, they did discuss it with me (once I could prove that I knew what it looked like, what my return address was, etc) and even agreed to allow the intended recipient to collect it.My TV is broken!
Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j0 -

If the seller has refunded the buyer, then technically an Unpaid Item Dispute can be opened. It may seem unfair, but unfortunately it is the only way to guarantee getting your listing fees back afterwards. You could send a Mutual Cancellation, however the already irate buyer can refuse the request, and you are stuck with the fees.
It will also leave the buyer with an Unpaid Item Strike, however eBay will remove this at the buyers request if they prove they did originally send the money. It's highly likely to wind up the buyer even more than they already, but some may say they deserve it...!
And believe it or not, there is NOTHING in eBay policy forbidding this course of action.<--- Nothing to see here - move along --->0 -
OK - so this morning got husband to contact delivery office and not mention that he was not parcel recipient. Postie chap confirmed that parcel has been in office since 6th May which indicates delivery was attempted on Tuesday 6th May or before and parcel has been in the office awaiting collection since (he did actually say 5th May but that was a Bank Holiday so I've said 6th May).
I have posted this info on the paypal dispute but will they still definitely force a refund if the buyer can't be bothered to pick up the parcel after he wasn't there to accept delivery in the first place?0
