Help I have been ripped off by seller

I agree with what Leezuk has to say. The seller should be able to claim from his postal service if, as he claims, he has proof of postage.
However, as an experienced seller he should know the paypal terms and conditions and protect himself as far as possible.
Virtually all my auction sales are paid by paypal. For all small items I trust to a certificate of postage and would refund the buyer if something didn't arrive. However, for larger items I always add the 65p recorded delivery charge into the post and packing and don't allow people an option to remove that, then I am protected.

Since asking him for the tracking number, which he brags he has, I have heard nothing further from him so maybe he is not as clever as he thinks he is. I have my daughters wedding on the 20 th November to think about so at the moment he is at the back of my mind. Many thanks for all your replies. They are ver much appreciated. If you are paypal verified you can chargeback from your card.and they sting the seller:

I used my switch card to pay via paypal. I went to the bank and they said there is nothing they can do to return my money. They also said that the amount had to be over £100 before a credit card company gets involved. The amount for the cape was £37. Paypal charge £15 to investigate this transaction.0

ebay charge £15 to investigate this problem not paypal so i dont think you will pay £15 to paypal.

As tab99_uk said paypal don't charge a fee for a straight forward reclaim of payment made on a non delivered item.
How did they tell you about the charge, was it by e mail or did you get a pop up on the paypal page.
Have you actually commenced the straight forward 'dispute' claim via paypal?

I put a claim against this seller with paypal and they sent me an email back with a case number on. The next day I received the email from him saying he had proof of postage. You know you have had it etc etc. Since I requested the tracking number I have heard nothing. I am that stressed out with the problems linked with my daughters wedding and other things I just feel like saying forget the whole sorry transaction and be more careful next time. I really do appreciate all the help everyone has given me with this rotter.

Go back into your paypal account and check on the status of the dispute. It doesn't matter what he is sending you as 'proof', paypal is handling it now so you need to see what they are doing.
Going back into your resolution centre should show what is happening as far as paypal is concerned. They should have given him 10 days to respond to *them* with proof of delivery.

Linda, that is good. It means that the seller hasn't protected himself by having proof of delivery otherwise he would have let paypal have the information and stopped the dispute by now.
Ignore all future e mail from the seller, keep it though in case of problems later. Leave it with paypal to sort out.
He only has 10 days to respond to paypal which is probably running out now, so leave it with them and don't have any more contact with the seller.
