Help I have been ripped off by seller

Can any of you kind people help me
I bid on and won a faux fur cape for my daughter to wear at her wedding. Before I bid I emailed the seller to find out how long it would take to arrive as at that time the wedding was 6 weeks away. He emailed my immediately to say 7-10 days usually or 2 weeks if he was busy.
I paid £37 using paypal as soon as the auction ended.
It is now 2 weeks to the wedding and there is no cape and no answers to the 5 emails I have sent him asking where the cape is.
I have noticed several transactions like mine on his feedback but he just says he has proof of postage.
Can anyone give me ideas how to sort this mess out. I cannot afford to buy another cape as I amregistered disabled and am living on disability pension. Many thanks

if the seller has proof of posting. then he should instigate a non delivery complaint with the post office.
does he say when he posted it?
have you checked postal address with him, ie i find a lot of people have different addresses registered with ebay and paypal.
if they do i always email them to confirm address.smile --- it makes people wonder what you are up to....:cool:

The only info on his details is an email address. I dont know how to get any other info. He hasnt said anything to me as to whethter he has posted it he has chosen just to ignore me and I am getting more annoyed as each day passes.

If the seller has good feedback for selling then this might just be a Royal Mail foul up. I recently had a parcel take 25 days to get to me and in that instance the post office compensated me for the excessive delay.
You need to get the sellers details and give him a call. If you do a search you get the option of an advanced search. In that option you can input the user id and item number that you bought and the sellers details will be sent to you via e mail in a few minutes.
If the seller has proof of postage then he will be able to claim up to £28 back from the post office for the lost parcel. However, the post office will not even consider a claim until a full 15 days from posting.
However, having said all that assuming you paid less than 30 days ago then you need to start a paypal chargeback IMMEDIATELY. If you go past the 30 days you have no opportunity to make a claim so start it now and let the seller worry about getting in touch with you.
If he only has proof of posting then he won't be covered for chargebacks and you should eventually get your money back. The only way he can prevent a chargeback is to prove delivery and wthout a signed recorded delivery or special delivery form that is impossible.
To start the chargeback log into your paypal account and look at the tabs across the top of the page. Click on resolution centre and follow the instructions.

I have looked on ebay to try and find more ID but all I can find is his membership id and I have his email address but I cannot find a home address or phone number for him0 -

Don't worry about phoning him, get the chargeback started first if you are running near to the 30 days, that is more important.
Then to get his contact details go into your ebay and click on buy (near top left of page). Click on advanced search and then scroll down the options on the left hand margin and choose find contact information. Then just complete the application to obtain the sellers id. All you will need is his user id and the item number.

I have now put a claim in against this man who resides in California although the location on the details of the item was UK. It is great that there is a website where you can get help from sincere people so once again thank you0 -
Since I have put a claim in against this man with paypal low and behold I have recived an email from him.
A very threatening email saying "You know you have had this item. I have proof of posting, I am going to report you and start an investigation against you "
I am just an ordinary law abiding lady who is registered disabled and all I wanted was for my daughter to have a lovely cape to complete her lovely wedding dress. The wedding is only 2 weeks away so the nerves a a bit tense as it is.
I have just lost my son in law to a heart attack at the age of 32 and my neice has had a prem baby weighing one pound four ounces.
Compared to what has happened this guy is just small fry but it all adds up. I have 100% good feedback on ebay and he is threatening to ruin this. All his negative feedback says the buyers did not receive their goods and his answer is always the same "I HAVE PROOF OF POSTAGE," He may have proof but I havent had my cape.

Proof of postage is insufficient for the seller to stop the chargeback process. Paypal require him to prove delivery, not posting, an entirely different matter.
Ignore his mail, don't block him as his mail might be useful in future, but if possible can you get someone else to read it before you store it safely somewhere? I get ridiculously upset by nasty email and once before when i had a problem (not ebay) I got someone else to read the mail just in case there was something important in it, if there wasn't then I just stored the mail safely and took a proper copy onto CD Rom in case I needed it for proof of threats later.
He knows he's wrong amd he knows he'll lose with paypal and he is trying to frighten you into giving up the claim. Let paypal handle it now, he has 10 days from the time you started the claim to respond and prove delivery before Paypal do anything else.
As for starting an investigation against you what for? You are quite rightly following paypal procedure for claiming your money back due to non receipt of an item. If he doesn't like it then his problem is with paypal and their procedure not with you.

I so agree with this. Try not to let it upset you (difficult I know!). This seller is totally in the wrong and doesn't like the fact that you seem to know what to do about him! Don't reply to his emails, just deal with him through Paypal or Ebay.

Speaking as a seller who recently sent an item worth £58 without any additional insurance which never arrived at the buyers house - I was really upset - one at Royal Mail for losing such a huge package/two at myself for not insisting on compulsory additional insurance - this would then have covered both the buyer and seller for a mear 50p extra (up to £100 - I insist on it now for items over £28 - you can request it as a buyer aswell). Having said all that I still felt that I had a responsibility as a seller to trust the buyer and send her a replacement only charging for half the postage - I think I lost at least £25 - but at least she was happy and I felt a sense of pride! Sorry yours hasn't worked out so well - not all e-bayers are as untrustworthy - just remember to read feedback first before you buy - you should be able to claim from the postal system as sender or receiver can claim - Good Luck!stay lucky!
