MONEY MORAL DILEMMA. Would you drink someone else's champagne?

    The 30day/6month time span was changed in 2000 - there is no longer any need to wait. Once a company sends you unsolicited goods, then belong to you, and it is an offence to demand payment for them.

    Of course, whether it applies in this case, as they weren't addressed to you remains to be seen, and isn't a comment on the ethics of depriving Deirdre, or the company of this bottle, and of course, this isn't legal advice - I could be mistaken

    I would hold on to it for a week, then I would buy a bottle of Brandy, mix the two and have a nice drink!!! :-)
  • I would most definitely contact the company who sent it to let them know of their mistake, if their details are listed. It is then up to the them to decide whether to collect it or not, at their expense.
    I have to get back to work, when I stop rowing the slaveship goes round in circles.

    There is definitely a moral in this story!!

    A few months back, I received an order from Elemis that had someone else's stuff packed in my box (which has cost a lot more than my order :rotfl: )

    I worried about what to do....do I keep quiet...do I ring them up...and in the end I decided to ring them up to let them know.

    The lady on the phone thanked me for my honesty and told me there was no need to send them back - and she hoped I enjoyed the products!!! :money:

    So I got to keep them after all, without denting my good karma :rotfl: :rotfl:

    So ring up the champagne company - if they want it back, you have still not lost anything as you were never meant to have it in the first place!

    If the delivery company was City Link, I'd keep the bottle - they owe me at least that for mucking me around several times over the past couple of years...

    If it was from Virgin Wines, I'd keep it because I know that all Deidre has to do to is call them up and report it missing to receive a replacement case. So win - win.

    This happened to us (sort of ) a few years back just before Christmas.
    A case of Champagne arrived on our doorstep and the card was addressed to the previous owners.
    Dutifully we phoned them and they came round and took the Champagne
    ALL 12 BOTTLES!!!

  • If the delivery courier's address was the only one I could find on the package then I would take the champagne out of the box, put it on ice and enjoy it later with my partner. Knowing how delivery couriers work it would be impossible for them to track down the original sender.
    If there was an indication of the sender's address then I'd contact them to let them know they can pick it up as it was delivered to me in error.
  • We received a parcel from Marks & Spencer, right address and postcode but wrong name. I only realised after the courier had left.

    I discovered that a house in a neighbouring village had the same name (no numbers here in rural Somerset), in a street with the same name, and a similar postcode.

    It took a few phone calls but eventually another courier came to collect the parcel.

    M&S gave me a £10 voucher for being honest, so we were rewarded for our little bit of effort. :T

    The Theft Act 1968 states that "Any assumption by a person of the rights of an owner amounts to an appropriation, and this includes, where he has come by the property (innocently or not) without stealing it, any later assumption of a right to it by keeping or dealing with it as owner.". People have been successfully prosecuted for theft after spending money they mistakenly received in their bank account, keeping the champagne in this case is theft, simple.
