  • i am a single parent who lives on income support. i have had an account with abbey for the past 10 years. throughout this time i have often gone into the red with the bankcharges only to be added on top!! i payed for my statements to be sent to me only to find that they ommited 4 months statements in random. after contacting the ombudsman they forwarded more statements but not the missing ones. after reading the post on finacial hardship, i have written to have my case heard. fingers crossed. i think im owed loads!!

    Extract from the FSA Waiver Direction to Banks (issued July 21st) on how banks should treat customers who claim financial hardship. You could quote any that apply to you:
    Complainants in financial difficulty:

    (19) from the date of this direction, the firm must ensure a fair, consistent and intelligent filtering of new complaints in order to identify relevant charges complaints from complainants who claim to be in financial difficulty and then assess whether that claim is justified. For the purposes of this direction, a complainant is considered to be in financial difficulty when his income is insufficient to cover reasonable living expenses and meet financial commitments as they become due;

    (20) the firm must ensure that the standards in section 14 of the Banking Code guidance for subscribers, March 2008 version (‘the Code’), for dealing with customers in financial difficulty are complied with in respect of relevant charges complaints, in so far as they are relevant, even if the firm is not a subscriber of the Code. As a minimum, the FSA expects the firm to take the steps described in Annex 2 of this direction in dealing with a customer who claims to be in financial difficulty, including making an assessment of financial difficulty;


    Annex 2 – Dealing with complainants in financial difficulty

    1.
    The firm will be sympathetic and positive when considering any financial difficulties claimed by the complainant. Firms will not subject a complainant to harassment or undue pressure when discussing their problems.

    2. In making an assessment of financial difficulty the firm will take into account:

    a.
    evidence of changes in lifestyle, including loss of employment; disability; serious illness; imprisonment; relationship breakdown; death of a partner; starting a lower paid job; parental/carer leave; and starting full-time education;

    b.
    evidence of the following events:
    i. items repeatedly being returned unpaid due to lack of available funds;
    ii. failing to make loan repayments or other commitments;
    iii. discontinuation of regular credits;
    iv. notification of some form of insolvency or court proceedings;
    v. regular requests for increased borrowing or repeated rescheduling of debts;
    vi. making frequent cash withdrawals on a credit card at a non-promotional rate of interest; and
    vii. repeatedly exceeding a credit card or overdraft limit without agreement (and, in this regard, where a complainant has incurred over £500 in unauthorised overdraft charges in the previous 12 months, that is to be treated as indicative of financial difficulty).

    3. If during the handling of the complaint the firm becomes aware (including by notification from the complainant) that the complainant may be in, or heading towards financial difficulties, the firm will contact the complainant to outline their approach to financial difficulty cases and to encourage the customer to contact the firm if the customer is worried about their position. The firm will also provide signposts to sources of free, independent money advice.

    4. The firm will make available to complainants straightforward information in plain English on the firm’s procedures and systems for dealing with customers in financial difficulty.

    5. If it becomes clear to the firm that the complainant needs specialist assistance, the complainant will be referred promptly to a specialist team that deals with customers in financial difficulties, if one exists. The firm will give a phone number on all communications that will put the customer in contact with a named person or a team dedicated to dealing with cases of financial difficulty.

    6. Where the firm does not have sufficient evidence to assess whether or not the complainant is in fact in financial difficulty, the firm will seek such further relevant information as is reasonably required to make that assessment. In the event that the firm reasonably requires relevant information to be provided by the complainant and the complainant does not provide the requested information within a reasonable period of time, the firm shall not be obliged to treat such a complainant as being in financial difficulty.[/quote]
  • Hi i was wondering if there is a template letter for making a claim for financial hardship. As i have a loan to pay and 2 credit cards and i will be out of a job end of august due to place i work closing down. I will then be going in too full time education. I already have all my charges worked out on spreadsheet and i also wanted to know if anyone had address for sending complaints to natwest. Thanks Mike

    Also when claiming for hardship do you need to send letter why your claiming hardship, Spreadsheet of charges and Normal claiming template. Cheers

    Basically yes send your claim with your list of charges etc and your reason for claiming hardship.

  • Hi guys im new to these threads but im looking into claiming money back from my account with Halifax i was made jobless about 6 months ago so paying my overdraft has been hard i am claiming jobseekers allowance that works out around £95 every 2 weeks but that covers nothing as my over draft is £750 i canceled as many DD's and SO's as i could using my online banking but yet i still have things coming out that dont get payed and me being charged £30 every time.
    i had to move house because of my unemployment so after going into the local branch and explaining my situation saying i was unemployed and claiming benefits you would have thought something would have been done..bit no..:mad:

    in there eyes would this count as a hardship claim and if so do you guys think i would have any success in making my claim
    Over the 6 years you can look at to claim charges wise its about 6k without the 8% interest! :confused:

    also after watching one of the video's its come to my attention that my PPI i could claim on aswell as i tryed to make a claim through it (due to me being unemployed) and it came back that i was not eligable for the claim and case was closed, the PPI was added onto the loan amount so do you guys think i would have any leaway there aswell:confused:

    if the ppi didnt pay out you should be able to claim it back. lok for the template letters on this site.

    Under the latest waiver you should qualify as hardship under more than one catagory. put your claim to the bank and see what they respond
