I need your help again! I sent the 12+2 day letter back and I received the following response from Activ Kapital;
We refer to your recent request for documentation under the Consumer Credit Act 1974.
We are unable to process your request as we have been unable to confirm the relevant information required despite repeated written requests.
Therefore, we are returning your £1.00 fee. We would still be happy to assist you, however we will need to confirm the required information.
We would ask that you contact this office without prejudice on the above telephone number in order for us to progress with this matter.
We look forward to hearing from you soon.

So what should I do now? Do I just leave it or send another letter?

Sorry, I sent the letter with the £1 postal order for my credit file, they then sent me a letter asking me to call them, I then sent the 12+2 day letter and the above was what I received back.0

I am very confused.
Your credit records are held by experien,. equifax and Callcredit, and cost £2 each to obtain, from them.
If you want your consumer credit agreement, then you need to request youe CCa and send £1.
If you want to find all the documentation in your file that is owned by a creditor you send a subject Access Request which costs £10.

After cancelling the direct debit I set up over the phone, the second payment date has been and gone. I sent the statute barred letter to Aktiv Kapital weeks ago. They didn't reply to my letter.
Now they are calling me on a DAILY basis while I am at work. Two nights ago they called again and caught me in. I told them not to phone again and I would rather any correspondance was done by mail. The woman accepted this and ended the call.
Yesterday they phoned about midday and spoke with my girlfriend. The guy was very forward and had to stop himself a couple of times from making a threat. They phoned today and my girlfriend told them what time I would be home (I want them to deal with ME, nobody else). I'm going to give them hell when they phone, but there must be a way to stop all this harassment.
Should I enquire about who their regulator is and threaten to report them? What can I say/do to convince them to just drop it?

Do you have proof that they received the statute barred letter?
And since this debt is statute barred why are you even talking to them? it gives them hope that they can bully you into paying.
You need to start by advising them that you have read about the action taken by the OFT against 1st credit last month and that you are compiling a formal complaint about their actions to the OFt and Trading standards.
Did your statute barred letter refer to the Data Protection Act? If so also report them to the Information Commissioner.
