    I tried to phone a few months ago to make a payment and even though I knew all the details and had made the first payment and arrangement over the phone the guy wouldn't accept it and said if he did he would lose his job so I stopped phoning after that and just made the payment monthly via my bank account and they've accepted payments that way. Maybe I just got an awkward person.

    If your father wasn't aware of the debt in his name, I would pay it off in full, or just continue the current arrangement.

    try again I would - ok on data protection it is a bit dubious - but you want to pay so I would try again!

    Or write from your Dad and you sign it (marking it pp) and see if they write back!

    NEVER phone them - they will twist what you say into an admission of debt or offer of full payment.

    As suggested, you CAN sign pp your dad - dca's have an obligation to deal with nominated third parties, so I would include a paragraph stating that ALL further negotiation is dealt with by you.

    For those of us unfortunate enough to have had, or are having, dealings with this bunch of reprobates, you may (courtesy of fermi) be interested to know just who you are dealing with:

    Not only have they posted a loss of £40,000,000 - sufficient alone to question their solvency and, by implication, their legal status - but two of their principle directors have resigned in the last two weeks. One of these was the Director of 'trace and compliance' and the other was Director of 'people and development'.

    Despite this, AK have, in the last three months, purchased 'debts' with a face value of £65 million. This certainly begs the question as to 'how much of that debt would be, if challenged, unenforceable through the Courts?

    A 'new' UK Country Manager - by the name of David Sheridan - is due to take up his post next week, with a brief to 'improve collections performance and implicate more efficient ways to communicate with debtors'.

    Looks as though they have no intention of 'bowing out' gracefully. :rolleyes:

    After sending these Activ Kapital another letter which I found on this website. They sent me a reply telling me after investagating the account, it would be statute barred so they have closed the account. So thanks everyone who helped.

    I now hope Capquest follow suit, they are trying it on at the moment, but hopefully they will bug*er off!!!

    Just make sure you keep that letter somewhere safe incase they 'forget' what they have said and come back next year. Good luck with Capquest.

    Thanks Gerorge, Yes I have kept all my records from the DCAs, just Capquest to deal with now and removing my defaults.

    I want to remove 2 defaults I have paid them, that's why I asked about the £1 postal order fee.
