Just ignore it - keep the letter in case you need evidence of what is now 'harassment' - and never phone them. :beer:I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.

Hello Rog2 and GeorgeUK
I've not heard from Aktiv's solicitors/agents yet. Hopefully they'll disappear forever..Rog2 wrote:
No problem, L_G - just don't send them anything else until they reply (if they reply) to your cca request. After 12 working days, from receipt of your request, they will be 'in-default' anyway if they don't comply with your request. At that stage there is a second letter that you can send, but they will be unable to enforce the debt without permission from the courts
May I know what second letter is that please?0 -
For those of us unfortunate enough to have had, or are having, dealings with this bunch of reprobates, you may (courtesy of fermi) be interested to know just who you are dealing with:
http://www.credittoday.co.uk/news/news-item.cfm?news=1015#content
Not only have they posted a loss of £40,000,000 - sufficient alone to question their solvency and, by implication, their legal status - but two of their principle directors have resigned in the last two weeks. One of these was the Director of 'trace and compliance' and the other was Director of 'people and development'.
Despite this, AK have, in the last three months, purchased 'debts' with a face value of £65 million. This certainly begs the question as to 'how much of that debt would be, if challenged, unenforceable through the Courts?
A 'new' UK Country Manager - by the name of David Sheridan - is due to take up his post next week, with a brief to 'improve collections performance and implicate more efficient ways to communicate with debtors'.
Looks as though they have no intention of 'bowing out' gracefully.
It's a mind torture being chased for a debt and it feels even worst when the debt doesn't even belong to you.. I wonder how these people live and act normal when they know fully well how they make so much money making other people miserable..
Hell is on earth while Aktiv is around..0 -

If they do send anymore letters do I ignore those too?
Hi MJ,
I find ignoring them completely is the best method of dealing with these scumbags. I started getting letters about a year ago and have never responded to any of them despite threats of sending round agents and taking me to court etc.
Must admit they had me rattled a couple of times and I was starting to get a bit panicky every time someone knocked at the door so I can fully understand how people cave in to the pressure and just pay up to make them go away.
I've not had any letters from them since xmas now though, so fingers crossed they've finally given up! ... or am I tempting fate by posting this :rotfl:“You can please some of the people some of the time, all of the people some of the time, some of the people all of the time, but you can never please all of the people all of the time.”0 -

Yes, Dai - it IS too good to be true.
If you acknowledge that the 'debt' is yours, then the ONLY offer that you should consider is one that is made as a 'Full and Final Settlement Offer' - Accept NO other wording whatsoever:
http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=24_full_and_final_settlement_offers
If, on the other hand, you dispute the debt, or any part of it, then you should request a copy of the original consumer credit agreement (cca), which AK must, legally provide you with within 14 working days of receipt of your request - without this, they can not pursue the debt through the Courts:
http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=getting_a_copy_of_your_credit_agreement_and_account_details
Is this an 'old' debt? If you have not made any payment towards it, or acknowledged it in writing for a period of six years, it may be 'Statute Barred' and unenforceable anyway:
