I am being hassled by Aktiv and also by Call Serve for an alleged debt of over £10K. Aktiv did say in one letter that the debt was originally with GE Finance. Now to my knowledge I only ever bought one thing through GE - a tv for £90 from Currys about 10 or more years ago and that was paid up in full. I suspect this may be something an in-law has bought using my details as they have done it before and cost me a poor credit rating (and a more expensive loan when I wanted one).
As I am now retired with no need for (or desire to acquire debts from) further credit I really dont need to clear my name in any way so I wrote to both asking them to prove the debt using the standard template letter from this site.
Aktiv acknowledged the letter and £1 PO and said they were trying to get a copy of the CCA. I have heard nothing since so have sent off the 12days +2 letter. If I hear nothing I will write again after another 4 weeks or so and after that will report any further harrassment (as my wife has chronic depression I have to keep all this out of her sight). If they do send the CCA (and if as I assume it is over 6 years old) I will send the statute barred letter.
Call Serve did not reply BUT I got a letter from a firm called Debt Managers in Edinburgh returning the £1 PO and saying that they had referred the case back to Aktiv as they were unable to obtain a copy of the CCA. As the PO was crossed and assigned to Call Serve I am assuming this is okay.
One parasite down and one to go.
Many thanks for all the advice on here without which I would undoubtedly have made fatal mistakes in handling these idiots. Do you know that 1st credit have had a serious boolocking last month and other DCAs appear to be in the pipeline?
If any of them cause trouble, complain as there is a good chance of action - at last.If you've have not made a mistake, you've made nothing0 -

Without this site I think I would just have agreed some sort of payment to keep them at arms length so many thanks. You guys do an amazing job in helping these parasites' victims. If ANY of the correspondence that you have received from AK is, in the least part, offensive, threatening or abusive, then you should report them to Trading Standards.
There are strict guidelines, laid down by the Office of Fair Trading, as to how these 'people?' should go about their often questionable affairs:

Failure to adhere to these guidelines can result in the loss of the credit license, which ALL Debt Collection Agencies need in order to conduct their business.
However, in the past, the OFT has been seen as a 'soft moderator' by the Debt Collection Industry, thereby attracting many of the less scrupulous companies, such as AK, MacKenzie Hall and 1st Credit, who see debt as a license to print money.
Fortunately the OFT appears to be 'toughening their act' and are cracking down on the abuse of privelege that these vultures pursue.
No 'alleged debtor' should be afraid to report any questionable behaviour by these 'legalised thugs'.I am NOT, nor do I profess to be, a Qualified Debt Adviser. I have made MANY mistakes and have OFTEN been the unwitting victim of the the shamefull tactics of the Financial Industry.
If any of my experiences, or the knowledge that I have gained from those experiences, can help anyone who finds themselves in similar circumstances, then my experiences have not been in vain.

Hello All,
I have recently with the help of this forum sent a CCA requst to Aktiv Kapital asking for the CCA of a debt they are asking me to pay.
They have had the 12 days plus well about an extra week as they send me letters saying they were not able to deal with the CCA request unless I called them. (which I was not willing to do)
Then this weekend they sent me another letter, outline of letter below
We refer to your recent request for documents under the consumer credit act 1974 we are unable to process your request as we have been unable to confirm the relevant information required despite repeated written requests (All they have asked me to do is call them)
therefore we are returning your £1.00 fee. We would still be happy to assist you however we will need you to confirm the required information.
We would ask you to contact us in order for us to progress this matter
we look forward to hearing from you soon.

So this letter makes me think they dont have the CCA to send me... Where should I go now, is there a follow on letter I can send them?? Any help would be great.

Don't be put off by their provarication, IKW. They are 'In Default' and they know it - simply trying to 'keep dialogue open' to divert your attention from the fact that they have failed to send you a true copy of the executed cca within the legally prescribed time period.
Doesn't matter that they have returned your £1.00 'statutory fee'. This does NOT absolve them from their legal responsibilities in any way.

Thanks for your feedback, I have not yet sent any further letters apart from the one asking for a copy of the CCA which they have not been able to send.
I will get a copy of the letter you mention printed and sent off to them and hopefuly this will be the end... Well I can always hope.

Just a quick update, Aktiv Kapital phoned again the other night and got me in. I stopped the guy and told him not to call again. I explained that the debt is statute barred and before I could even continue he said "now that you've told us, I can now terminate this call".
They haven't been back in touch but I'm still going to send off the letter to have my details removed from their records.0
