    Ditto! To a company called Lombard Tricity which I believe no longer even exists!

    AK have now passed me onto another company, received letter other day. Just going to continue ignoring them ;)

    Hope someone can help, are Aktiv kapital and Credit Security part of the same company? My partner had letters from AK in dec 09 (i think) but just ignored them. He then got one from Credit Security. He called them to sort it out as the debt was his and he has been paying them £150.00 per month for around a year. When I questioned him about proof of payment etc he said he's never had any and he has no paperwork relating to CS at all as he lost the original letter (and has never had any since). He does however have the AK letters so I registered online to see how much was outstanding etc and the amount owed is on there but I cant generate any statements. All we can do is pay money off. He pays via debit card that CS automatically take each month but has swapped bank accounts so has a new card number. This means this months payment hasnt come out. Is it bad to just not bother contacting anyone to sort out paying again?

    I have never heard of Credit Security, but after a few minutes on Google, it seems to me that the Debt has been Sold / Passed on to Credit Security Ltd based in Aylesbury. You should look up the template letter for notice of assignment, which you should send to them to make sure that they own the debt before you carry on blindly paying. Your OH should have recieved an annual statement. When you know for sure that they have the right to collect or on who's behalf they are collecting then there are things you can do to protect yourselves and possibly reduce the total outstanding.

    Hi,
    new to the forum so i hope someone can help me urgently with this matter, my husband had an old debt from over 10 yrs ago which he defaulted on and it was on his credit file for 6 yrs but is no longer there, at the time he did not pay anything of this debt due to financial difficulty, now he is receiving letters weekly from a debt collection agency AKTIV KAPITAL (UK) LTD, & DEBITASK COLLECTIONS AGENCY FOR SAME DEBT, I assume they are both the same company as ref no is the same, they say they have been instructed by their client to request full payment or a payment schedule to be made, they have said they will send a collection officer to our address if he fails to make contact within 5 days, they are texting him daily to ring a number regarding this debt, can they do this, does he have to pay this debt despite it already being removed from his credit file and it being so old, does he have any rights, can they force him to pay this debt of just over £1,000, can they do any further damage to his credit file if he does'nt pay, we are not in a position to pay this debt off at the minute anyway,what can we do to sort this matter.....are we still liable to pay this debt..we have read somewhere that the debt may be statute barred as it is over 6 yrs old, how do you know if this is the case with an old debt, and also can they do this, and can they re-report this debt on his creditfile despite already being on once and now removed yrs ago, :)HELP PLEASE

    Hi bertisbus, If you read through this thread you will find all the information you need as well as links to template letters you may want to send.

    I don't know of any connection between Aktiv and Debitas, only that often Aktiv use another DCA to back up their meaningless threats.

    Have you replied to any of their letters? if you haven't then its up to you whether or not you reply. I can only say that if you want to get them off your back find the Prove it letter, combine it with the Threat of a doorstep visit letter telling them that you know anyone they may (this is the word they use) send will not be allowed on your premises and that they have no more right of access than a paper boy.

    Goes without saying that most debts are statute bard if they have not been acknowledged for 6 years (5 in Scotland) and that AK are well known in these parts as Chancers

    Any questions after you have had a search of the thread please post again, hopefully one of our better experienced friends will post their advice as well.

    ok i worked there as a manager for 8 years. i will tell you how debt really works... your debt is stat barred which means they cant cahse you for it anyway. however if you dont know this there is no law to stop them.

    ask them when the default date was (from the creditor) if its more than 6 years, your DONT have to pay and and can tell them to stop sending letters and calls. if not your go to OFCOM and the oft.. this will fine them right away.

    if they come out with an old !!!! and ball linbe like, once you have admitted to the debt the 6 years start again.. this is a LIE... dont pay it.. there getting desperate. when i was there we were truning over 6.4 million a month. now with the managers they have there only turning over 1.2 ... how very sad to think they have spent all that time finding the best managers only to find out they havent.

    Hi, today is your lucky day.

    do not pay. i was a manager there for 8 years. Thames credit was sold to AK and sorry to say AK have no idea what they are doing.
    if your debt is 6 year old (from the default date) then you DONT have to pay a penny.
    this means it was on your credit report and once of, there is nothing they can do about it and it wont show on your credit report which means it dont affect you.
    what AK do is offer a silly discount to try and get you to pay... DONT.
    they think people dont know the law and this is why they put pushy things in there letters like , pass to there legal team or field agents will come to your house.
    dont worry. if its 6 years old, tell them that if they outsouce it (field agents) your get them done by the OFT and ofcom. believe me they will crap them selves. also they might pull a line where they say, if you admit to the debt the 6 years start again.... A LIE..... it dont.

    and what ever you do dont pay if they offer you a big discount... ask your self why so much of, its because they cant really collect on it so any money is better than none.

    hi, to day i will be your angel.
    nope there not the same. they have outsouced the account because there collectors dont have the skill to get you to pay.
    easy way around this, tell them to sod off :)
    ring AK and ask for the default date. if its 6 years from the default date them they cant do sqwat all about it.
    tell them if agaents turn up (which will be a little man with a book asking for a fiver a month) them them the OFT and ocfom will be called and you will report them to watchdog.

    believe me we wrote debt of if people said this. AK brack more laws than people believe. if they got investagated them close... we use to and still know they do, dop calls on customer via there dialler which will get the shut down if OFCOM got of there back sides and looked into.

    so please relax, send them best wishes for Pete, ex manager :)

    hi i was a ex manager there.. love the input.. and please IGNORE them.
    what they do is pass the debts on they cant collect on because there stat barred... as for the default date and if 6 years old. tell them watchdog, the oft and ofcom will be called... THERE STOP :) all the best. any more infor about them i have DETAILED files on.
